City Council Minutes 09-15-1986 I I I MIN TES SPECIAL MEETING - MO TICELLO CITY COUNCIL Monday, September 15, 1986 - 4:45 p.m. A special meeting of the City Council was held for the express purpose to c Lot 4, and the southeasterly 90 feet known as the Old Fire Hall. Members Fair, Bill Fair, Jack Maxwell. Membe dUly called by Acting Mayor, Fran Fair, nsider whether or not to sell f Lot 5, in Block 34, the site resent were: Dan Blonigen, Fran Absent: Arve A. Grimsmo. With Acting Mayor, Fran Fair, presiding, the meeting was called to order. Administrator Eidem explained to the C uncil that Mr. Wayne Brinkman, representing National Bushing, had giv n an oral indication that he would purchase the old Fire Hall site, excluding a parcel where the City's pump house is located, for the ity's asking price of $88,000.00. Eidem noted that certain easements wou d be required to be placed over, under, and across the property in ques ion. Councilmember Bill Fair asked that he be brought up to date on the easements required. John Simola, Public Works Director, explain d that a utility easement would lie across the northwesterly 54 feet 0 Lot 4, and that a separate utility easement would lie across the southeas erly 18~ feet of Lot 4, and that a 15-foot alley easement would lie acr ss the northwesterly 15 feet of Lot 4. Simola also noted that a re trictive covenant, prescribed by the Minnesota Department of Health n order to protect the water quality in and around the pump house, ould be required. Councilmember Fran Fair asked if there were any known problems with the structure. Staff responded that t e structure was sound but would be remodeled to accommodate National B shing. Councilmember Bill Fair stressed that simply because the conve ance was occurring with City acting as the seller, there were no va iances or permits automatically guaranteed outside of the Zoning Ordin nee. Eidem acknowledged that any building permits would have to go hrough the regular process, and that the sale of the real estate provided no assurances of development other than those guaranteed by the Zoni g Ordinance itself. Councilmember Maxwell felt that the ask"ng price agreed upon between Eidem and Brinkman was extremely reason ble considering the limitations being placed on the property by both th easements and the covenant.
