AN ORDINANCE GRANTING A FRANCHISE TO BRIDGEWATER TELEPHONE
COMPANY, LLC, DBA TDS TELECOM, TO CONSTRUCT, OPERATE AND
MAINTAIN A CABLE SYSTEM AND PROVIDE CABLE SERVICE
IN THE CITY OF MONTICELLO, MINNESOTA
NOTICE IS HEREBY GIVEN that, on September 26, 2011, Ordinance No. 537 was adopted by
the City Council of the City of Monticello, Minnesota. Due to the lengthy nature of Ordinance
No. 537, the following summary of the ordinance has been prepared for publication as authorized
by state law:
SECTION 1. The ordinance adopted by the Council grants a franchise to Bridgewater
Telephone Company LLC, d/b/a or operating as TDS Telecom, to construct,
operate and maintain a cable system and provide cable service to residents and
businesses in the City of Monticello, Minnesota.
In keeping with the state requirement that no agreement can have terms and
conditions more favorable or less burdensome than an existing agreement, the
Bridgewater/TDS Telecom Cable Franchise Ordinance is almost identical to the
Cable Franchise Ordinances that were approved with Charter Communications
and FiberNet Monticello. This does not limit TDS Telecom from exceeding the
provisions as stated in the ordinance.
The proposed ordinance outlines the ability for Bridgewater/TDS Telecom to
build a cable system and offer cable service, sets a franchise term to expire March
29, 2020, and establishes the service area as the corporate boundaries of the City.
There are sections describing the system capacity, community service
programming, drops and services to public buildings, and provisions related to
franchise fees.
SECTION 2. This ordinance shall take effect and be in full force from and after its passage and
publication. A printed copy of the whole ordinance is available for inspection by
any person during the City's regular office hours, and is available online at
www.ci.monticello.mn.us.
