AN ORDINANCE AMENDING SECTION CHAPTER 3 AND CHAPTER 5, SECTION
3.2 (B), TABLE 3-2, OVERLAY ZONING DISTRICTS; SECTION 3.7, OVERLAY
ZONING DISRICTS; SECTION 5.1, TABLE 5-1, USES BY DISTRICT; AND
DELETING SECTION 5.2 (F)(1), ADULT USES; OF THE MONTICELLO CITY CODE,
KNOWN AS THE ZONING ORDINANCE, BY PROVIDING FOR THE
ESTABLISHMENT OF AN OVERLAY ZONING DISTRICT FOR THE PROVISION
AND REGULATION OF ADULT-ORIENTED LAND USES, AND AMENDMENTS TO
THE OFFICIAL ZONING MAP REFLECTING THE APPLICATION OF SUCH
OVERLAY DISTRICT TO SPECIFIC PROPERTIES AS DESIGNATED HEREIN.
NOTICE IS HEREBY GIVEN that, on April 25, 2011, Ordinance No. 528 was adopted by the
City Council of the City of Monticello, Minnesota. Due to the lengthy nature of Ordinance No.
528, the following summary of the ordinance has been prepared for publication as authorized by
state law.
Section 1: The ordinance adopted by the Council amends the City Zoning Ordinance by
providing for the establishment of an overlay zoning district for the provision and
regulation of adult-oriented land uses, and coordinating amendments to official land
use map. The ordinance provides for the following:
• Adds the Special Use Overlay District to the Overlay Zoning District Table;
• Adds the Special Use Overlay District and provides for:
o Appropriate restrictions on adult uses
o Provides adult-oriented uses as accessory uses in accordance with the
accessory use standards under section 5.3(D);
• Amends table on Uses by District to delete adult uses from the base zoning
districts as permitted, accessory or conditions uses;
• Deletes Section 5.2(F)(1) containing adult use restrictions within the general use
standards;
• Amends the Official Zoning Map by applying the Special Use Overlay District.
Section 2: A printed copy of the whole ordinance is available for inspection by any person
during the City's regular office hours. Amendments as approved will be incorporated
into the online Zoning Ordinance following publication.
