Mr. Wes Cochrane of Busine s Development Services, Inc. presented a summary of the Labor Market Survey to the IDC. Three uses for the informa ion: 1) To describe the labor force, 2) To help define a targeted marketing strategy, 3) to answer questions of specific business/industry. CONTINUED. couple. IDC MINUTES - 10/27/88 6. CONSIDERATION OF AN INFECTIOUS WASTE FACILITY IN THE OAKWOOD INDUSTRIAL PARK. The IDC briefly discussed he infectious waste facility proposed for Lot 4, Block ,Oakwood Second Addition. The small facility would blrn infectious waste tons p/hr under the limits under cur ent Pollution Control Agency enforceable regulations, t erefore, the PCA only has guidelines which are not e forceable. The PCA is in the process on establishin regulations for this size of an opertion. The DC agreed that it's the stagma associated with suc a facility which requires educating the public, cont nued research, and advised the staff to move very slo in determining if Monticello would become the home of t is infectious waste facility. 7. CONSIDERTION OF THE EXISTI G MONTICELLO-BIG LAKE AIRPORT. Mr. Harvey Kendall has beel contacted by the present owners of the local airpor which would like to talk with city officals about t e possible cooperative efforts for improvements in achieving ~vailable funds MDOT/Aeronautics Division. The new owners lave an option for additional farm land and the City of Jig Lake was not interested in a joint community effort. Jeff O'Neill will contact the owner. . 8. CONSIDERATION OF THE PAVEMENT STRENGTH EVALUATION OF THE INDUSTRIAL PARK ROADS. AN ORDINANCE OF THE CITY OF MONTICELLO, WRIGHT COUNTY, MINNESOTA PROVIDING FOR THE CREATION OF AN ECONOMIC DEVELOMENT AUTHORITY. WHEREAS, the city Council for the City f Monticello (herinafter referred to as the "City") has the authority to establish an Economic Development Authority (hereinafter referred to as t e "Authority") pursuant to Sections 469.090 to 469.108, inclusive, as amended, (the "Act") of the Minnesota statutes; and WHEREAS, all due process requirements f r the establishment of the Authority, including the pUblic hearing., have been met; and WHEREAS, based on all information prese t, the City Council hereby finds that the establishment of an Economic D velopment Authority is in the best interest of the City. NOW, THEREFORE, THE COMMON COUNCIL FOR E CITY OF MONTICELLO 00 ORDAIN that an Economic Development Authority 0 be known as "the City of Monticello Economic DeveloPment Authori y" is hereby established pursuant to Sections 469.090 to 469.108, inclusi e, as amended, of the Minnesota Statutes which Authority shall operate ccording to this ordinance enacted pursuant to the charter of the City on he following terms and conditions which shall be adopted as the By-laws 0 the EDA. . 1. CREATION A. The Economic DeveloPment Auth rity shall be composed of 5 members to be appointed by th Mayor and confirmed by the City Council. B. Two of the members shall be mbers of the City council. The terms of office of the two me ers of the City Council shall coincide with hisjher remaini g term of office as a member of the City Council. C. The remaining three (3) members shall be initially appointed for terms of two, three, four, an five years respectively and one member for six years. Therea ter, all commissioners shall be appointed for six-year terms, xcept that any person appointed to fill a vacancy occurring prior to the expiration of the term which his/her predecessor has · een appointed, shall be appointed only for the remainder of such term. Upon the expiration of his/her term of office, the me er shall continue to serve until his/her successor is appointed. D. All members shall serve at the pleasure of the City Council. The City Council shall make vailable to the Authority such appropriations as it deems f t for salaries, fees, and expenses necessary in the conduct of ts work. The Authority shall have authority to expend all budg ted sums so appropriated and recommend the expenditures 0 other sums made available for its use from grants, gifts, and ther sources for the purposes and activities authorized by thi resolution. F. A Commissioner may be by the City COuncil for inefficiency, neglect , or misconduct in office. A Commissioner shall be remove only after a hearing. A copy of the charges must be given to the Commissioner at least 10 days before the hearing. The Co issioner must be given an opportunity to be heard in pe son or by the counsel at the hearing. When written charge have been submitted against the Commissioner, the City Counci may temporarily suspend the Commissioner. If the City CO ncil finds that those charges have not been SUbstantiated, the C mmissioner shall be immediately reinstated. If a Commissione is removed, a record of the proceedings together with the charges and findings shall be filed in the office of the Ci y Clerk. 2. OFFICERS AND MEETINGS. A. The Authority shall elect a p esident, vice president, treasurer, assistant treasure, and secretary annually. A member must not serve as pres dent and vice president at the same time. The other offices may be held by the same member. The offices of the secretary nd assistant treasurer need not be held by a member. B. The Authority shall adopt rul sand precedures not inconsistent with the provisions of the or inance or as provided in Minnesota Statutes, Section 469.096, an as may be necessary for the proper execution and conduct f the business. The Authority shall adopt by-laws and rules to govern its procedures and for the transaction of its busines and shall keep a record of attendance at its meetings an or resolutions, transactions, findings, and determinations s owing the vote of each memeber on each question requiring a vote or if absent or abstaining from voting, indicating such fact. The records of the Authority shall be a public record, exce t for those items classified by law as non-public data. C. The Authority shall meet at Ie st once a month. Special meetings may be called by the hairperson as needed. D. All administrative procedures ncluding contract for services, purchases of supplies, and fin ncial transactions and duties shall be outlined in the By-la s of the Authority. ~ . . . Ordinance No. Page 3 3. STAFF A. The Economic Development Dir ctor shall be designated as Executive Director of the Au hority. B. Subject to limits set by the appropriations or other funds made available, the Authority may employ such staff, technicians, and experts as may be deemed pro er, and may incur such other expenses as may be necessary and proper for the conduct of its affairs. 4. FUNcrIONS, POWERS, AND DUTIES A. Except as specifically limit d by these provisions in Section 5 of this Ordinance, the Autho ity shall have the authority granted it pursuant to Minne ota Statutes 469.091 - 469.107, or other law. B. The Authority shall manage t e Greater Monticello Enterprise Fund (the "Fund") the purpos of which is to encourage economic development by making loans 0 private businesses. The EDA shall make loans to eligible businesses and such loan(s) shall serve a public purpose as de ined in the Greater Monticello Enterprise Fund Guidelines (und Guidelines). The Fund Guidelines are hereby adopte by reference and included in the By-Laws of the EDA. No chan es to the Fund Guidelines shall be made without approval of the City Council. c. The Authority may be a limit d partner in a partnership whose purpose is consistent with t e Authority's purpose. D. The Authority may issue gene al obligation bonds and revenue bonds when authorized by the city Council and pledge as security for the bonds and full faith credit and resources of the City or such revenues as may be g nerated by projects undertaken by the Authority. E. The Authority may cooperate ith or act as agent for the federal or state government or a sta e public body, or an agency or instrumentality of a gover nt or other public body to carry out the powers granted it by the act or any other related federal, state, or local law in the area of economic development district improvement. F. The Authority may annually d velop and present an economic development strategy and pre ent to the city Council for consideration and approval. ~ . . . . . Ordinance No. page 4 G. The Authority may join an offi ial, industrial, commercial, or trade association, or other or anization concerned with such purposes, hold reception of of icials who may contribute to advancing the city and its eco omic development, and carry out other appropriate public relat'ons activities to promote the city and its economic develop nt. LIMITATIONS OF POWER A. The Authority may not exercis any specific powers contained in the Act, Minn. stat. 462, and 472A without the prior approval of the City council. B. Except when previously pledge by the Authority, the city COuncil may, by resolution, r uire the Authority to transfer any portion of the reserves nerated by activities of the Authority, that the city COU cil determines are not necessary for the successful operation of the Authority, to the debt service funds of the city, t be used solely to reduce tax levies for bonded indebtedne s of the city. c. All official actions of the uthority must be consistent with the adopted comprehensive pl n of the City and any official controls implementing the co rehensive plan. D. The sale of all bonds or obl gat ions issued or levying of taxes by the Authority shall be ap roved by the city COuncil before issuance. E. The affairs of the Authority shall be limited to promoting the growth and development of rcial and industrial concerns in the City of Monticello. F. The Authority shall submit a I planned activities for influencing the action of an other governmental agency, subdivision or body to the C ty Council for approval. 6. BUOOET AND ANNUAL REPORT A. The Authority shall prepare n annual budget projecting anticipated expenses and sou ces of revenue. The Authority must follow the budget process fo City Departments as provided by the City and as implemented y the City Council and Mayor. B. The Authority shall prepare n annual report describing its activities and providing an ccurate statement of its financial condition. Said report shal be prepared and submitted to the City of Monticello by March st each year. 8. MODIFICATIONS. A. All modifications of this or inance must be in written form and must be adopted in accordanc with the charter of the City. '"
