Planning Commission Resolution 2019-017CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA PLANNING COMMISSION RESOLUTION NO. PC -2019-017 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MONTICELLO RECOMMENDING APPROVAL OF REZONING FROM "A -O", (AGRICULTURE OPEN SPACE) TO "R -A", (RESIDENTIAL - AMENITIES DISTRICT), 66R-199, (SINGLE FAMILY RESIDENCE DISTRICT), AND 66PUD" (PLANNED UNIT DEVELOPMENT DISTRICT) FOR `HAVEN RIDGE" PIDs: 213-100-234101; 213-100-234103; 213-100-242200 WHEREAS, the applicant has submitted a request to amend the Land Use Map of the Comprehensive Plan from "Urban Reserve" to "Places to Live"; and WHEREAS, the applicant concurrently seeks to extend utilities and develop the property for a mix of single family residential uses and townhouses; and WHEREAS, the applicant proposes to plat the property into a series of single family and townhouse lots for purposes of residential development; and WHEREAS, the applicant proposes to develop the plat and property consistent with the requirements of the R -A, Residential Amenities, R-1, Single Family Residence, and PUD, Planned Unit Development Districts; and WHEREAS, the property is located within the Monticello Orderly Annexation Area, and subject to the MOAA agreement between the City and Town of Monticello; and WHEREAS, the site is contiguous to the City boundaries, the developer has presented plans to extend municipal utilities, and meet other requirements of the MOAA agreement; and WHEREAS, the proposed development plan is consistent with the requirements and process for annexation under the MOAA agreement; and WHEREAS, the provision of low density housing in the area provides for uses consistent with the City's Comprehensive Plan policies for land use and incorporation of natural features; and WHEREAS, the City conducted an Environmental Assessment Worksheet for the project identifying potential environmental impacts, and WHEREAS, the project to be developed pursuant to the Comprehensive Plan Amendment will be able to meet each of the mitigation requirements of the EAW; and CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA PLANNING COMMISSION RESOLUTION NO. PC -2019-017 WHEREAS, the proposed plat and development plan are consistent with the requirements of the proposed zoning districts, subject to compliance with the conditions recommended by Planning Commission and final approvals to be considered by the City Council; and WHEREAS, the Planning Commission held a public hearing on July 2" d, 2019 on the application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the Planning Commission of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: 1. The Comprehensive Plan amendment provides an appropriate means of furthering both the intent and the specific goals and policies for housing as identified in the Comprehensive Plan, generally and for the subject site. 2. The site qualifies for annexation under the MOAA. 3. The use of the site(s) for low density housing is consistent with the long-term expectations for housing in the area, and for future surrounding land uses. 4. The proposed use will have positive impacts on municipal public services, including extensions of sewer, water, stormwater treatment. 5. The proposed utility and street improvements resulting from the Comprehensive Plan Amendment will be facilitate the long-term plans for development of such systems to protect and improve public safety. 5. The ultimate development of the site will be required to meet the regulations of the various zoning districts, as reviewed and recommended or modified by the Planning Commission and City Council. NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of Monticello, Minnesota, that the Planning Commission hereby recommends that the Monticello City Council approves the Rezoning, based on the findings listed above and subject to the following conditions. 1. The City approve the requested Comprehensive Plan Amendment. 2. The applicants provide legal descriptions of the areas to which the proposed three zoning designations are to be applied. 3. The zoning designations take effect concurrent with the City approval of the preliminary plat. 2 CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA PLANNING COMMISSION RESOLUTION NO. PC -2019-017 1. The City approves the requested Annexation and such annexation is processed by the Office of Administrative Hearings per the Monticello Orderly Annexation Agreement.
