Planning Commission Minutes 10-18-1982 . . . MINUTES SPECIAL MEETING - MONTICELLO PLANNING COMMISSION Monday, October 18, 1982 - 7:30 P.M. Monticello City Hall Members Present: Jim Ridgeway, John Bondhus, Richard Carlson, Ed Schaffer. Members Absent: Joyce Dowling. 1. Approval of the Minutes of the Meeting Held on September 14, 1982 Meeting. A motion was made by Bondhus and seconded by Carlson with all voting in favor to approve the minutes as stated. 2. Public Hearing - Variance Request - Ruff Auto Parts. Ron Ruff of Ruff Auto Parts was present at the planning Commission meeting to request permission for a variance to build an additional storage building on Ruff's Salvage Yard property. Because the auto salvage business is in a R-I zone and is a non-conforming use, it was necessary that a variance be considered in order to allow the erection of this additional Lndoor storage facility. Because the Planning Commission members felt that it was more aesthetically pleasing to the neighborhood to have as much storage done inside as possible, out of view of the neighbors and passerbys, a motion was made by Bondhus and seconded by Schaffer to recommend approval of this variance request for a pole type building to allow for more indoor storage of salvage auto parts with all voting in favor. 3. Public Hearing - Rezoning Request - Mrs. Les Carlson. Mrs. Les Carlson made an application for rezoning her property from R-l to B-3 in order that she might be allowed to rent her business location (Formerly Carlson's Welding Shop) to someone who might be eligible for a conditional use in order to establish an auto sales facility. Mrs. Carlson was unsure of what the difference between R-l and B~3 zoning was and questioned when the property was zoned R-l property and also wanted to know if it was possible to have her taxes on the former welding shop reduced in cost since it is no longer being used as a welding shop and is by ordinance residential property. - 1 - . . . Planning commission Minutes -lO/l8/82 There was objection from several neighbors regarding this rezoning request. A letter was read by Mr. Dale Dahl objecting to this rezoning request as well as Roger Schwientek, a neighbor, objecting to the rezoning because he felt the property was zoned R-l and pur- chased his home on the basis that conformance of the non-conforming welding shop would be required at some time in the future which would ensure a continuity of residential zoning in that area. Mr. steve Johnson, another neighbor, was present and stated that he understands Mrs. Carlson's feelings about wanting to have her property rezoned to make its income value greater than is present- ly allowed under R-l zoning. He also stated that he felt that the zoning within the City should be maintained and that the business should be expanded within proper zoning districts. He felt that the City should comply with and not alter the comprehensive plan. It was also Mr. Johnson's feelings that Mr. Gille's rights to maintain his auto sales facility adjacent to the Carlson property should be protected, but that he did not feel that Mr. Gille should be allowed to expand his auto sales facility in an R-l zone and that the property should not be rezoned adjacent to him to allow him to expand his auto sales business. Mr. Gerald Doerr was present to state that he has no objection to Mr. Gille's auto sales facility being continued in the location that it is, but that he would object to rezoning and a subsequent conditional use being granted to Mr. Gille to expand his auto sales facility onto the former Carlson welding ShOp property. Because the members of the planning Commission felt that the property owners were correct in their request that the comprehensive plan for zoning should be continued as it presently stands, a motion was made by Schaffer and seconded by Bondhus with all voting to deny this rezoning request to rezone the Carlson property from R-l to B-3. 4. Public Hearing - Conditional Use Request - Fred Gille. In item #3 previously stated, a request was made by Mrs. Les Carlson to rezone her property from R-l to B-3 and thus make it eligible for Mr. Gille to apply for a conditional use in order that he might be allowed to expand his auto sales facility unto the Carlson property which is immediately to the east of his existing auto sales facility. Reference at this point is made to the previous agenda item because those items which are stated in that minute item are also pertinent to item #4 in which Mr. Gille made his request for a conditonal use permit. The Planning Commission felt that they had recommended not rezoning the Carlson property to B-3 and therefore felt they did not want to recommend a conditional use for the same property which they had objected to recommending rezoning for, therefore, a motion was made by Bondhus and seconded by Schaffer with all voting in favor to recommend denial of the conditional use request. - 2 - . . . planning Commission Minutes - lO/l8/82 5. Public Hearing - Variance Request - Perkins and Monticello Motel. Mr. W.J. Murphy of the Monti Motel and Mr. steve Long, ,represent- ing Perkins Restaurants, were present to request that the Planning Commission consider granting them permission to erect a 70 foot high pylon sign upon which both Perkins Restaurant and the Monti Motel would display their pylon outdoor advertising. It would be Perkins intention that they would remove the existing pylon sign and that their new sign would be placed on the same pylon post with that of the Monti Motel. The request was for a 70 foot high sign which would be approximate- ly 22 feet higher than present Monticello ordinances allow which includes 32 feet from the ground surface plus the difference of the abutting road heights and the location at which the sign will be placed on the private property. Because the planning Commission felt in this case that one pylon sign, although slightly taller than is normally allowed, would be better than two pylon signs in a nearby location to one another, a motion was made by Schaffer and seconded by Bondhus to grant approval of this 70 foot high pylon sign which would include no more than 200 square feet of advertising for Perkins Restaurant and no more than 200 additional square feet for the advertising of the Monti Motel, with all voting in favor with the following covenant added: That an agreement be reached whereby Perkins Restaurant would not be allowed to have an additional pylon sign in addition to the one which they would share with the Monti Motel, but if they would chose to have a separate pylon sign on their own property at sometime in the future, that the Perkins Restaurant sign would have to come down off from the pylon which would at this time be shared with the Monti Motel on the Monti Motel's property. 6.
