City Council Resolution 2021-21CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION NO. 2021-21 A RESOLUTION OF THE CITY OF MONTICELLO APPROVING AN EXTENSION TO THE REQUIRED APPLICATION DEADLINES FOR FINAL STAGE PLANNED UNIT DEVELOPMENT (PUD), REZONING TO PUD, AND FINAL PLAT WHEREAS, the applicant is the owner of Outlot A, Monticello Business Center 6th Addition; and WHEREAS, the applicant has submitted an application for and received approval of a preliminary plat and development stage planned unit development for the replatting of Outlot A as the proposed Twin Pines/Monticello Business Center 7th Addition on January 27tH, 2020, for the purpose of development of a 95 -unit multi -family residential project; and WHEREAS, the applicant is required to submit an application for final plat within 360 days of preliminary plat approval and an application for final stage PUD within 60 days of approval of the development stage PUD; and WHEREAS, the applicant has submitted an application for rezoning to planned unit development and the City of Monticello is required to act on the application for rezoning to planned unit development within 60 days of application; and WHEREAS, the applicant has previously requested an extension of six months as related to the submission of the application for final stage PUD and final plat, and extension of action on the application for rezoning; and WHEREAS, on March 23rd, 2020, the City Council acted to grant a six-month extension for the final stage PUD application as allowed by ordinance to August 27th, 2020; and WHEREAS, on July 27th, 2021, the City Council acted to grant an additional nine- month extension for the final stage PUD and final plat application as allowed by ordinance to March 17th, 2021; and WHEREAS, the virus named "SARS-CoV-2," is a new strain of coronavirus that has not previously been identified in humans and can easily spread from person to person and which causes a disease named "coronavirus disease 2019," commonly known as "COVID- 1 %" which is a respiratory disease that can result in serious injury or death; and WHEREAS, the City of Monticello has adopted an Emergency Declaration as related to the COVID-19 pandemic under the authority given by Minnesota Statutes, Section 12.29, which declares that a local emergency exists within the City of Monticello, effective 4:30 p.m. March 27, 2020, with all the powers and responsibilities attending thereto as provided by Minnesota Statutes, Chapter 12, which directs City Staff to review ordinance and regulatory requirements, operations, civil and legal proceedings, events, and resources to determine whether the foregoing should be ad j usted or suspended, and to make recommendations regarding additional emergency regulations to support the employees and residents of the City of Monticello; and WHEREAS, the City Council has on March 8th, 2021 considered a request for extension of the application requirements for final plat and final stage PUD, and a request for extension of agency action timeline for rezoning to PUD, and WHEREAS, under the authority of the Emergency Declaration, the City Council of the City of Monticello finds that the extension request is appropriate and reasonable due to circumstances related to the pandemic. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello, Minnesota, that the request for extension to the required application deadlines for Final Stage PUD and Final Plat to September 8th, 2021 is approved, with the applicant's extension of the agency action period for rezoning to PUD, subject to all previously assigned and approved conditions per Resolutions 2020-021 and 2020-022.
