RESOLUTION NO. 2021-30
A RESOLUTION OF THE CITY OF MONTICELLO
APPROVING AN EXTENSION TO THE REQUIRED APPLICATION DEADLINES FOR FINAL
STAGE PLANNED UNIT DEVELOPMENT (PUD) AND FINAL PLAT FOR
SPIRIT HILLS SOUTH
WHEREAS, the applicant is the owner of Outlot B, Spirit Hills; and
WHEREAS, the applicant has submitted an application for and received approval of a
preliminary plat and amendment to development stage planned unit development for the
platting of Outlot B as the proposed Spirit Hills South, for the purpose of development of a
48 -unit single-family residential project; and
WHEREAS, the applicant is required to submit an application for final plat within 360
days of preliminary plat approval and an application for final stage PUD within 60 days of
approval of the development stage PUD; and
WHEREAS, the applicant has previously requested an extension of one year as
related to the submission of the application for final stage PUD and final plat; and
WHEREAS, on April 27th, 2020 the City Council acted to grant a one-year extension
for the final stage PUD and final plat application as allowed by ordinance to May 22nd,
2020; and
WHEREAS, the virus named "SARS-CoV-2," is a new strain of coronavirus that has
not previously been identified in humans and can easily spread from person to person and
which causes a disease named "coronavirus disease 2019," commonly known as "COVID-
19," which is a respiratory disease that can result in serious injury or death; and
WHEREAS, the City of Monticello has adopted an Emergency Declaration as related
to the COVID-19 pandemic under the authority given by Minnesota Statutes, Section 12.29,
which declares that a local emergency exists within the City of Monticello, effective 4:30
p.m. March 27, 2020, with all the powers and responsibilities attending thereto as provided
by Minnesota Statutes, Chapter 12, which directs City Staff to review ordinance and
regulatory requirements, operations, civil and legal proceedings, events, and resources to
determine whether the foregoing should be adjusted or suspended, and to make
recommendations regarding additional emergency regulations to support the employees
and residents of the City of Monticello; and
WHEREAS, the City Council has on April 26th, 2021 considered a request for
extension of the application requirements for final plat and final stage PUD; and
WHEREAS, under the authority of the Emergency Declaration, the City Council of the
City of Monticello finds that the extension request is appropriate and reasonable due to
circumstances related to the pandemic.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello,
Minnesota, that the request for extension to the required application deadlines for Final
Stage PUD and Final Plat to November 22nd, 2021 is approved, subject to all previously
assigned and approved conditions per Resolutions 2019-012.
ADOPTED this 26th day of April, 2021, by the City Council of the City of Monticello,
Minnesota.
