Planning Commission Minutes 04-26-1977 (Special Meeting) ,. ~ , . . ~ SPECIAL MEEI'ING MONTICELLO PLANNING COMMISSION April 26, 1977 -- 7:30 P.M. Members present: Howard Gillham, Fred Topel, Dave Bauer, Henry Doerr, Jim Ridgeway, J. W. Miller. 1. Discussion on Garage Variance - Larry Hartzler. Mr. Larry Hartzler discussed with the Planning Commission his desire to build a 2 car garage on Lot 1, Block A, Lower Monticello, and pre- sented two possible options. The first option was to enlarge the present single car garage located behind the house, requiring a sideyard variance to build within 2 feet of the property line. His second alternative would be to build an attached garage extending into the front yard, which would not require any variances. The Planning Commission recommended that in their op1n10n, the attached garage in the front yard would be the best alternative since a variance request to build within 2 feet of the property line may not be well received by abutting property owner. 2. Sideyard Variance Request - Ed Lane. Mr. Ed Lane requested a sideyard variance to build a 2 car garage within 5 feet of his property line. The property is located at the NE corner of 3rd Street and Chestnut, Lot 1, Block 42. Since the variance request would be abutting a portion of Chestnut Street not currently constructed, D. Bauer made a motion, seconded by F. Topel and unanimously carried to recommend approval of a variance to Mr. Lane to build his garage within 5 feet of the property line and to hold a public hearing on the request at the May 9th council meeting. 3. Mike Rajala inquired as to why a public hearing was not held on variance needed by Ernie Hartwig for a house he is building on Lot 11, Tract A, Block 5, River Terrace. Mr. Rajala indicated that the building will be within 6'$" of his property line and that a public hearing on the variance needed from 10' to 6'8" should have been held before he was allowed to build. Jay Miller, building inspector, stated that the building is 7'9" from the property line, while the abutting property owner, Mr. Rajala, feels that it is only 6'$". Mr. Rajala stated he had previously indicated to Mr. Hartwig that he would be agreeable to an 8' setback but would have been opposed to a setback of only 6'8". -' . . . .. The Planner, Dick Dwinell and Planning Commission members recommended that a public hearing on this sideyard variance should be held. D. Bauer made a motion, seconded by Ridgeway that a stop order on future construction be issued to Mr. Hartwig and that a public hearing be held on the setback variance if Mr. Hartwig wishes to continue building with- out proper sideyard requirements. It was also recommended that Mr. Rajala obtain a survey of his property to establish the exact distance Mr. Hartwig's buil~ng is now located from the property line. Voting in favor: Bauer, Ridgeway, Doerr; opposed: Topel, Gillham. Based on the recommendations of the abutting property owner, Doerr made a motion, seconded by Topel and unanimously carried to recommend to the City Council that a variance be granted to Mr. Hartwig if his building is 7'9" or more from the property line, but would recommend that the variance be denied if the building is located only 6' $" from property line. 4. Review of Comprehensive Plan - Dick Dwinell. Dick Dwinell of Howard Dahlgren and Associates reviewed portions of the Preliminary Revised Comprehensive Plan for the City and Orderly Annexa- tion Area. Further review of the plan will be held at the next scheduled Planning Commission meeting. J. Ridgeway made a motion, seconded by Bauer and unanimously carried to recommend the following be pw;sued by the City Council: 1) That a pedestrian crossing be established over I-94 on Highway #25 2) That a pedestrian crossing be established at the north end of the bridge leading to the River Inn 3) .And that no parking be allowed on the east side of Walnut Street in front of Oakwood School.
