City Council Minutes 04-18-1972VILLAGE 6F'IMONTICELLO Monticello, Minnesota 55362 April 189 1972 Public Hearing - 8 P.M. - April 189 1972 - High School Activity Room. All councilmen present: William Sandberg, Jeff Rowan, Dan Blonigen, Richard Martie, Walter M.a.rkling. Planning Commission members present: Robert Davis, Dale Lungwitz, Grant Schleif. Professionals: Charles Tooker, planner and Thore Meyer, engineer. Hearing called to order by'Robert Davis who proceeded to report that necessary lePal announcements had been made and published relating to the hgarinp. Mr. Davis introduced Charles Tooker who explained the goals and ob- jectives of the planning and zoning and exolained each chase of the proposed Zoning Ordinance chapter by chapter. Mr. Davis opened the discussion to hearing questions or comments.. Dr. John Kasper: My question is in regard to C-1 zoning. What if I own a lot not complying to size measurements. Davis: You may build on it as it is plotted and you own it before adoption of this ordinance. Larry Krenz, Clearwater: Block S is designated C-1. I bought this block for highway business development. Davis: This area does open opportunity for change. This was zoned C-1 as it is a low terrain along here. However, this area can be considered for change. Wm. Schachor: My area is zoned R-39 multiple dwelling. How does this affect my present location and business? Davis: You may apply for a non -conforming use permit to pro- tect your property for as Song as vcu'is for this op- eration. Schachor: I would request that this be left B-2 zone. Davis: Planning Committee will study and advise. Doug Pitt: I have existing business in R-3 with extra land for expansion. Where do I stand? Tooker: You may qet a non -conforming use hermit. Business may stay, as it is. You may not expandunder the ord- inance. The Board of Adjustment may studv and may give a decision in this regard. It is feasible we could add funeral homes to conditional use list for R-3 zone. Public Hearing -- April 18, 1972 Page 2 Bud Fair: I'm zoned R-3 now. Can you grow restricting a business district to eight blocks? Business district should go from Third to River from downtown all the way to the high school. John Kasper: Consider a larger area. Davis: We are trying to create order so business is not mixed in kith homes. H. Hillstrom: I suggest that business zone be run along railroad track all the way east and along Highway 25. Consider it. C". Olson: I live in Minneapolis. I own business property on Hit? 25. It's now zoned R-3. It has been a sign shop, repair shop. It's now a repair shop-- my tenant does repair work and sells used cars on the side. This is business property. Davis: The Planning Commission has no intention of creating a hardship for anvone. We want to protect the best interest of everyone. Olson: I don't feel protected, I assure vou. Kenneth Maus: Change that area zoned R-3 to B-2 around the down- town area. Move R-3 geared to older people housing out farther. W. Gustafson: My house is in zone B-2. what happens do I have to move out? Davis: It will stay a residence as long as you want to be there. Geo. Phillips: The Hospital takes up 10 or 11 acres in C-1 zone. Can we expand to related services without going to con- ditional use or non -conforming use? I talk about clinics, convalescent home, etc. Tooker: I understand the problem. C-1 is designed to provide for oven space i)ublic use land. Related services of this nature would need to be written into C-1 ordinance. Planning Commission will consider. Eddie Schaffer: You are minute on the business district -- expand it. I'll sell my place to give you more room. H. Busch: I'm in B-2. I don't want a business next to my house. Public Hearing -- April 18, 1972 Page 3 C. Olson: What recourse do we have short of going to court? Tooker: If approved zoning ordinance does not meet with your approval ,you may appeal to Council for rezone. Other- wise you'd have to resort to court. Davis: Thank .you all for airing your comments and observations. We'll move to the next item on the agenda -- the placing of carrier lines through I-94. Introduction related to Droper publishing of notice of hearing. Bids for 3 water carrier lines and one sewer line received last week. Low bid was $17,634.00. Thore Meyer, engineer gave background on planning and thinking for nroviding Dronosed lines. Cost is major factor. Placing now at $17,634.00. Estimate about $200 Der ft. after blacktopping or over $200,000. Hillstrom: Why should there he a Question when there is such a difference in cost? Answer: Two of the crossings are in the township. Reply: The crossings are on state, Kasper: If we grow so much this side of the freeway are the water supply and sewer facilities adequate to take care of more. would it be cheaper to put in new sewer plant on other side of freeway or enlarge this one? Meyer: Water supply is adequate. We can pump 2500 gallons a minute. Treatment plant designed for 5000 persons. Runs about capacity now. Plant designed to be expanded when needed. Seness: I'm sure hearing was legal requirement. Let's hear from opponents to speak first. Sandberg: I think east end crossings are out of village too. It is the policy of the village to assess 100% to benefitted Droperty owners. Who's going to nay for it when there's no benefitted Droperty served. It may be years before it is needed. Speculators will benefit. I don't believe in putting it in the ground now. Answer: The return is in a round about way. Increase in tax base with property improvement. Assess 100% to users- when hooked up. No service facility slows down growth. Public Hearing April 18, 1972 Page 4 Sandberg: They can put in new plant and new well beyond I-94 when they need it. Kasper: Spend the $17,000 now. It is no Ramble. Schaffer: Industry comes oiit. To put in water and sewer plant is costly. Provide them with service now to enenurae-e them. If needed later -- add sewer plant and well. Crimsmo: we have ponulation of 1700. This is an investment of $10.00 each. This is the nroiect bargain of the decade. Markling: We have t8O,000 in the liquor fund Certificates of Deposit. Borrow $17,000 from this; it won't hurt the village. No tax assessment. Seness: People coming will pay. We're advancing; money comes back. Stan Hall: We started annexation discussion ,years ago. Some against at first; some change back and forth. we've spent $15,000 now to promote annexation. If we don't spend $17,000 now and don't get any annexation there is no need for it. Lee Hatfield: I'm not on the Planning Commissionv I'm not in the Oak.. wood Corporation. The Planning Commission should be praised, not criticized. They're trying to develop a plan to insure growth of the town. Fair: who's our go - go - go? Doug Pitt: We get ouestions like: Meat land is available in town? Do you have water and sewer service available? We have to answer no. An investment --of $17,000 will get it for us. Don Pitt: I was chairman of the Development Cornoration for several years. We hear comments from citizens. 'Ke need industry. Our school system is the envy of many. We need job oonortunity to keen our Rraduates. J. Poirier: What is the time table? Answer: Council must award contract within 30 days from Arril 11. Contractor has 45 days to complete.
