RESOL=oN MUNTING EASEMWT TO OSCAR PJMSON FCR THE PURPOSE OF RUMUNG A ERAM LINE
UNDER A VII,ZAGE STREET
Whereas: A request has been received by the village council of the village of Mmtoicello
by 11r & mrs Oscar Pierscn to riun a drain line ander and across West River street and
under the east edge of Oak street to the Mississippi river for the pu cgose of drain-
ing basement water from their home located just outside the vill4e Limits on West
River street.
Be It Therefore Resolved: That the village council of the grillage of Monticello, being
informed that without the drain line requested water continually stands in the base-
ment of the above mentioned home, does hereby grant easement to Mr. & Mrs. Oacar
Pierson, their heirs and assigns to install and maintain a drain Line as requested
with the follawing conditions being realized:
(1) All expenses incurreddin installing and maintaining such drain line w1l" be
boarn bar the parties requesting the permit.
(2) The Village of Monticello nor the Village Council shall not be held liable f cr
any damage incurred in installiand maintaining such drain lane.
(,I) This permit will not bind the village of Monticello from further developm mt
in this area and any damage to this drain line caused by the village or any parties
hiered by the village shall be at the expense of the parties requesting this permit.
(4) All properties must be restored to their originalcondition following the
installation of this drain line.
(5) This drain line shall not be used for the purpose of dry raw sewage into
the Ilii.ssissippi river.
