City Council Minutes 06-02-1964June 2 1964
Regular meeting of the village council held this date in the village hall.
Members present- Bergstrom, Adams, Kasper, Madsen and 3,,�^ranson. Absent- None.
I.1inute s of the meetings of May 4th and 11th were approved as read.
No objections were heard in considering the pitition to vacate Cedar (Mulbery) St.
ha4in lower Monticello. Motion by Kasper that we adopt the resolution vacating the westerly
Cedar Strect also listed as nulbery street on some mans in lower Monticello
Seconded by Swanson and carried unanamously.
G. Phillips and A. Christianson representing the Hospital board met with the council
and requested a larger water line to the hospital and also that the village would
establish the road grade on the extension of river street. Tabeled until (checking
with the village engineer as to cost.
A. Ifclntire, requested that the village install a stop sign at the corner of west
third and Linn street. Motion by Kasper to have A. McIntire order stop signs and
to have the village maintainence crew install them on west third street at the
corner of, Linn street. seconded by Yadsen and carried.
A. Kuehn requested that the village install a lead in to connect his home to the
village seTfrage system. Tabeled until meeting with the engineer.
Madsen was instructed to contact Jim Schaffer to see if he would accept the position
of village dog catcher.
A letter was recieved from N. Krueger in which he estimated the cost for installing
a storm sewer to drain t1he low spot by the Assembly of God church at $2,000.00.
He advised that this be installed at the same time t11W any sewer or water mein
extension to the hospital. village
The following letter was recieved from attorney Roger Tesch addressed tothe village
coundil: " After reading the May loth edition of the Monticello Times conserning
the dismissal of the maintenance foreman, I feel I must clear up any misunderstanding.
As Village Attorney I have done rUr best to be available ti1r}en any problems areso. I
was consultated on the Michaelis matter for the first time on I -larch 12th by Dr.
Kasper. This was after the council had already taken action. After researching the
pertinent laws on the matter, I infowned the Council t1hru. D -r.. Kasper- that I felt
the Veterans Preference Law (I-iinnesota Statutes 197.46) did apply in this case.

best for all conserned. This would allow both sides to resolve the mattOr without
further bitter niss. If this was not done, a Public Hearing must be called to prove
or disprove the cha»ge s against the f oreY;ian.
T ie Mayo-- i-ras advised that one of a mese two -d-- --L n U:Lv os should be taken as soon as
possable. The reason for this is that MSA 197-46 mfast be followed exactly. Regardless
of whether this is a good law or a bad law, removal of a village employee.. who is a
Veteran is forbidden until the statute is complied with. Technically this man is
still a village employee and probably is entitled, to his wages until such time as
he resigns or his dismissal is uprield by the Hearing Board.
The nez,,_spaper refers to an attorney's advise in the Irdchaelis I affair. Sence- appar-
ently more than one at-IDorney has been consultated, I feel this letter will clear up
any misunderstanding as to my posits on in this natter. Yours truly, Roger A. Tesch

R. Menzel stated th at P. Byrd had installed a few sewer cormlections and had the
trench filled in without the required inspection. Bergstrom is to call Mr byrd and
inform him the inspection must be coripl*ed with or his license would be revoked.
Complaint recieved by Grace Pratt that there is a lo,r spot in her boulivard that
h .d not been filled in when the sewer lead in was installed and also one by �rs.
F. E. Ellison th.--wt the gas Bo. had not filled in where they installed the line in
front of their place. m. Swanson was instructed to check on these and have them
taken care of.
F. Brenteson reported that he could not comply ii-Ith all contracts for digging in
seder connections beforb the first of July and requested an extension of time on
those he could not complete. 17iotion by Kasper to allow an extension of time to no
later than August 1, 1964 for those not being able to connect to the village sewage
system due to the lack of the contractors ability to install all sewers by July 1.
Those not being able -(-o connect by J4 1 and requesting an e_utension of time must
show a contract with one of -Uae licensed contractors showing the date of completion,
