City Council Resolution 2019-27CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION NO. 2019-27 A RESOLUTION OF THE MONTICELLO CITY COUNCIL APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT FOR GROVELAND 5th ADDITION AND FINAL STAGE PUD (PLANNED UNIT DEVELOPMENT) FOR LOT 1, BLOCK 1, GROVELAND 5th ADDITION WHEREAS, the applicant has submitted a request for Final Plat and Final PUD, consisting of site and building improvements in the B-3, zoning district; and WHEREAS, the Monticello Planning Commission held a public hearing on January 2"d, 2019 and February 26th, 2019, for the consideration of the Development Stage Planned Unit Development and rezoning to Planned Unit Development of Lot 1, Block 1 of Groveland 5" Addition, and the preliminary plat of Groveland 5th Addition; and WHEREAS, after taking public comment, the Planning Commission recommended approval of the Development Stage Planned Unit Development and rezoning to Planned Unit Development of Lot 1, Block 1 of Groveland 5th Addition, and the preliminary plat of Groveland 5th Addition to the City Council; and WHEREAS, the Monticello City Council reviewed the recommendation of the Planning Commission and approved the preliminary plat of Groveland 5th Addition on March 11 th, 2019; and WHEREAS, the Monticello City Council reviewed the final plat of Groveland 5th Addition on March 25th, 2019; and WHEAREAS, the preliminary and final plat for the Groveland 5th Addition identifies the specific plans and uses for the proposed Groveland 5th Addition; and WHEREAS, the requirements for Final Plat and Final Stage PUD consideration in the Monticello zoning ordinance have been met; and WHEREAS, the City Council has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the City Council of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: 1. The Plat and PUD provides an appropriate means of furthering the intent of the Comprehensive Plan for the site by continuing the development plans for commercial use. 2. The proposed improvements on the site under the Plat and PUD are consistent with the needs of the development in this location as a commercial area. 3. The improvements will have expected impacts on public services, including sewer, water, stormwater treatment, and traffic which have been planned to serve the property for the development as proposed. 4.. The Plat and PUD are consistent with the intent of the City's economic development objectives, as well as with the intent of the City's zoning regulations except as authorized by the Planned Unit Development. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello, Minnesota: The Monticello City Council hereby approves the Final Plat and Final PUD as submitted, adopting the findings of fact herein, subject to compliance with related codes and regulations for such use, and the following conditions: 1. Maintain lighting compliance with code, ensuring that lighting levels will minimize impacts on adjacent property. Wall pack and site lighting to conform to code requirements for cut-off shielding. 2. Prepare and submit sign plans that demonstrate compliance with Sign Ordinance regulations. 3. Noise Ordinance compliance — including no outdoor paging/speakers that are audible from adjoining residential areas. 4. Limit use of extended parcel to the south to landscaping and revise the landscaping plan to identify plantings and maintenance. 5. Compliance with the recommendations of the City Engineer's report dated March 21St, 2019. 6. Execute a Development Agreement for the plat and Planned Unit Development. 7. Execute a Stormwater Maintenance Agreement for the private stormwater and infiltration basin for the proposed development. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA, that the document titled "Development Contract and Planned Unit Development and for Groveland 5th Addition," with assignment of the specific terms and conditions for public improvements and the specific terms and conditions for plat development, is hereby approved.
