MINUTES QUARTERLY MEETING - MONTICELLO POLICE COMMISSION Wednesday, September 28, 2005 - 7 p.m. Members Present: Dick Slais, Jon Hoff, Brad Fyle, Dave Gerads and Wayne Mayer Members Absent: None Others Present: City Administrator, Rick Wolfsteller and Councilmember Tom Perrault I. Call to Order The meeting was called to order at 7 p.m. and a quorum was present. 2. Approval of minute of April 20.2005 Police Commission meetinl!. JON HOFF MOVED TO APPROVE THE MINUTES OF THE APRIL 20, 2005 POLICE COMMISSION MEETING. WAYNE MA YER SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 3. Review of Council action rCl!ardinl! School Boulevard speed limits and pedestrian crosswalk locations. Commission members reviewed the results of a traffic study that was conducted by the Sheriffs Department along School Boulevard from April 29, 2005 to May 5, 2005. The study noted that of the 27,000 vehicles that traveled School Boulevard during that time frame, the average speed was 47.85 mph in the posted 45 mph zone. Commission members were updated on a recent City Council action that authorized the City Engineer to conduct a pedestrian study along School Boulevard that has resulted in a decision to add an additional crosswalk near the high school across School Boulevard and to also construct temporary low cost improvements of additional signing, striping and pcdestrian ramps providing bump-outs along School Boulevard to see if this will slow traffic in the pedestrian crosswalk areas. As part of this discussion, the consensus of the Police Commission membership was to also request that the City Council consider adding a pylon in the center of School Boulevard at the crosswalk locations which identifies the crosswalk and the state law that requircs motorists to stop for any pedestrian in the crosswalk. Commission members felt this would be a low cost improvement that would provide advance noticc to motorists of the crosswalk locations which should help slow traffic in the area. Commission members also discussed the traffic concerns along the entire length of School Boulevard from Highway 25 easterly and noted with the recent opening ofWal-Mart and the additional commercial developmcnt that is occurring in the area, it was their recommendation that the City Council consider adding a four-way stop at the intersection of Cedar Street and School Boulevard, onc block east of Highway 25. Commission membcrs were informed that . . . Police Commission Minutes - 9/28/05 future plans did call for the installation of a traffic signal at this location if the traffic warranted, but a motion was still made by Dick Slais, seconded by Jon Hoff and unanimously carried to request City Council to establish a four-way stop system at this intersection as soon as possible. This request will be forwarded to the City Council for their consideration. 4. Discussion on l!eneral traffic $Deeds and enforcement procedures throul!hout the City. Commission members noted the main concern that they have heard from citizens is in regards to traffic enforcement for speeding. It was the consensus of the Commission members that additional enforcement regarding traffic speeds needs to be conducted by the Sheriffs Department, even if that means the City will have to add additional hours of coverage in the future to provide officers for this purpose. Recognizing that the preliminary budget proposal for 2006 has already been established by the Council, Commission members felt it is important that the City Council consider adding at least four hours of additional coverage next year (2007 budget) and possibly even up to eight hours a day, with this additional officer being responsible for traffic control enforcement. In the meantime, Commission members directed the City Administrator to contact the Sheriff s Department to have them step up enforcement along Broadway to at least get the message out to the general public that traffic speeds are a concern in the area. 5. Consideration of establishinl! a ioint meetinl! between Police Commission. City Council and Sheriff Department representatives to discuss basic law enforcement orocedures. Council member Tom Perrault reviewed with Commission members his idea of establishing a joint meeting between the Police Commission, City Council and Sheriffs Department representatives that would present background information to the general public at an open forum meeting. With the City's population growing at a rapid pace, Mr. Perrault felt that many citizens may not be aware of why the City has contracted for police protection services through the Wright County Sheriffs Department and it would give the Sheriffs Department an opportunity to explain what their role has been in law enforcement for Monticello and why the City continues to use their services. This open forum could also provide the Police Commission with the opportunity to provide cost eomparisons of using the Sheriffs Department for law enforcement compared to having our own police department. A study was completed a number of years ago that found it to be morc cost efJective for the City of Monticello to have its own police department, but it was recommended that the staff try to update this information and have it available for such a meeting. Originally a public forum date of Thursday, October 27, 2005 was discussed, but Commission members felt that additional time would be necessary to prepare a proper agenda for topics to discuss and in order to complete any type of comparison survey of police department costs trom surrounding communities. In order to provide proper public notice ofthis mecting, the idea was suggested to use our City quarterly newsletter and to usc the Monticello Times or Shopper for advcrtising the meeting. 2 . . . 6. Police Commission Minutes - 9/28/05 In preparation for a public informational meeting, it was the consensus of the Commission members that the Sheriffs Department should be contacted to see if they would be available for having a planning meeting on October 27,2005 that includes Police Commission members, City Council members, Fire Department representatives and the Sheriffs Department. This planning session could establish what type of agenda might be appropriate for this public meeting which would then be held at a later date to be determined. If this date is appropriate for the Sheriffs Department representatives, this date for a planning meeting would be brought to the City Council for approval. Miscellaneous In regards to speed enforcement procedures, Commission members felt it would be appropriate for City of Monticello to obtain its own radar trailer device which could be placed in various locations throughout the community to advise motorists of their speed. While it was noted that Wright County has two of these trailers available for use throughout the County, more and more communities are utilizing them making it difficult to obtain one for a specific area in Monticello without advance notice. With the cost of these devices in the $7,000 to $10,000 range, Commission members requested that the City Council consider acquiring its own device through next years budget. 7. Police Commission Agenda: 5/17/06 Review of process used bv Sheriff's Department to notify community of the presence of a sex offender. (RW) REFERENCE AND BACKGROUND: Recently Mayor Herbst received a letter from a concerned citizen questioning how the public is informed when a sex offender may be living in certain communities or neighborhoods. Apparently there has been rumors that Monticello may be home to a number of sex offenders and since this information has not been publicized, the question arises as to how does a community become aware ofthese individuals and when does this information get relayed to city officials? It is my understanding that depending on the level of severity for a sex offender determines how notification is made to communities where these individuals may be located. I have asked the Sheriff's Department to provide background information for the Police Commission members on the process that is used or the process that is allowed by state law so that everyone understands when and how city officials and residents are informed ofthese incidences. No specific action is anticipated at this time until after a report is received by the Sheriffs Department. . . . 4. A. (RW) REFERENCE AND BACKGROUND: With the construction of the new 1-94 bridge crossing on CSAH 18 and related construction activity along County Road 18 and Chelsea Road, road closures are diverting traffic from Chelsea Road down Fallon Avenue to intersect with School Boulevard to bypass the construction area. With the increased traffic volume now occurring at the intersection of Fallon A venue with School Boulevard near Little Mountain Elementary School, I believe a few accidents have occurred at this intersection and the Police Commission should review whether it may be appropriate to temporarily install traffic control devices along School Boulevard making this a four-way stop. Possibly a recommendation from the Sheriffs Department on the appropriate traffic control devices could be made, but it also may require the City Council to ask its city engineer to review and make recommendations on appropriate traffic measures. School Boulevard has initially been designed as the major east-west thoroughfare and it may not be appropriate to suddenly add stop signs at that intersection just because there is a heavier volume of traffic using Fallon A venue. On the other hand, since it is a temporary measure until the road closure is eliminated on Chelsea Road, it may be an appropriate recommendation. After discussing with Sheriff representatives, a recommendation could be made to the City Council for further action. . . . 5. A. Police Commission Agenda: 5/17/06 Consideration of recommendation to City Council for removinl! the traffic lil!ht at River Street and TH 25. (RW) REFERENCE AND BACKGROUND: Commission members may also want to provide input on a recommendation to the City Council regarding the traffic signal located at River Street and Highway 25. It has been suggested that this location for a traffic signal has caused backups along TH 25 and it is questioned as to whether continuing to allow River Street to cross TH 25 is appropriate anymore. Originally MnDOT was not in favor of the City having a signal at this location but it was decided when TH 25 was improved a number of years ago that the community wanted to keep the River Street crossing available and therefore the only way to do it was to have a traffic signal. If the traffic signal was to be eliminated, possibly a median could be placed across the intersection and still allow right-ins and right-outs to occur from both directions, or if this was deemed unsafe, because of visibility issues, both directions would have to be closed off and the street end in cuI-de-sacs. If commission members feel that this is an issue that the Council should consider, possibly the committee could make a recommendation that one way or another the City Council could review at a future meeting. Again, at this time it is up for discussion and input and possibly the Sheriff's Department would have a recommendation. . . . Police Commission Agenda: 5/17/06 6. REFERENCE AND BACKGROUND: The Sheriff s Department has been asked to prepare an activity report that they could present to the commission members on recent activity and any enforcement issues that commission members should be aware of. No specific action is required is other than to review any information provided by the department. . . . 7. A. Police Commission Agenda: 5/17/06 Consideration of Walt's Pawn ShOD License Renewal. (RW) REFERENCE AND BACKGROUND: Recently the City Council considered a conditional use permit amendment that allowed Walt's Pawn Shop located on South Highway 25 to permit outdoor storage and sales of various items related to the pawn shop business. As part of the conditional use permit process, discussion did occur on whether the owner of Walt's Pawn Shop was complying with the City ordinance regulating pawn shop activities. The City had become aware that the owner of the pawn shop, Mr. Randel Thompson, had been found by Sheriff Department representatives to not be entirely complying with the city ordinances regarding property recording of merchandise being received and especially related to items that had been seized by other police agencies has being stolen items. The owner has previously indicated he had numerous computer problems, but it does appear that the computer software and equipment is not the entire problem with complying with city ordinances. As a result, the pawn shop was granted a monthly license renewal rather than an annual license, with the understanding the Council expected the operator to comply with city ordinances or face the possible revocation of his license. Enclosed you will find a brief summary that was prepared by Dave Clemons of the Sheriffs Department who has been the responsible individual for ensuring compliance of the pawn shop operation with city code. The City Council will again be reviewing the license renewal at an upcoming meeting and it may be appropriate for the commission members to get a report from the Sheriffs Department on how they feel the operation is doing and whether it merits license renewal. I spoke to APS persolllle! Phil Ha:fVenstein and Mary Pederson. Phil and Mary were concerned about problems with Walt's Pawn not complying with the rules of APS. 1 was given a synopsis of the problems encountered by APS. I met with the owner of Walt's Pawn, Randall Thompson. I introduced myself and told him I was assigned the APS detail for the Sberi1rs Dept. .1 spoke to Randall many times after that original meeting. We discussed issues with his not notifYing APS of daily transactions. Randall explained that he was having some computer program problems. I watched aa Randall attempted to receive the files from APS. These files would not open on his computer. 1 explained to Randall that 1 saw that this was a real problem. 1 also explained to Randall that it was his responsibility to get the computer program to function properly. We discussed that it was his business and by not gettiog tbisproblem resolved he would be held accountable. 01110/07/05 I ran a check of missing transaCtion days and found 29 days missing from 1 0/04/05 pack to 6/04/05. I also noted many pages of errors 00 individual transactions. 1 spoke to Randall about these problems and the computet was again the reason given for the errors. It,was again explained that he was responsible for getting the computer "fixed". 01:11 ~/1I05 1 received an e-mail from Mary Pederson with some further information on problems:with Walt's Pawn Shop. Mary told me in this ~ail that Walt's has 96 pages of outstanding errors. There are 36 missing transaction days from 9/04 to current (1111105) 25 pages from 1/02105 to 8/4/05. Randall had let his Xpawn phone support service agreement lapse on 5/24/05. He therefore:did not get the latest APS code updates. XPawn is the software that is used to track: all sales at the pawn shop and assista in reporting sales to APS. I then drafted a letter requesting Randall correct his missing transactions and that it is his responsibility to send daily reports according to Monticello City ordinance. This was delivered on 11/9/05 an&he was given until 11118105 to correct the problem. He did attempt to fix the missing days but did not prior to the deadline. I then drafted a second letter requesting Randall comply with the confiscation reporting component of APS. A deadline of 12/19/05 was given to comply with the confiscation notices. As of this date, 4/21/06, Jiwe have not received any documentation for confiscations. I have personally recovered items on three separate dates from Walt's Pawn during this time and these confiscatipns are still not reported by Randall. Shortly after January I" 2006 I had phone conversations with Rick Wolfsteller from the City ofMontice1lo regarding Walt's Pawn Shop. There has been a few misSing days here and there but overall it is ;nuch improved. TI:)e confiscation notification issue has still' not been resolved. Since the attempts to have Walt's co~ply we still have no confiscation notices; I am aware of Wright County Deputies recovering: stolen items in the last four months and none of these are reported by Randall as confiscatiphs. This poses a problem due to the fact that if outside agencies recover stolen property we in Wright County have no notifications of who was pawning stolen property. I ~poke to Randall on 4/24/06 and he explained that he is having trouble with Xpawn software as it relates to confiscations. He is trying to resolve this. I again explained to Randall that the computer problems are something he is responsible fOI" and he needs take care of getting it fixed. . This item came about because of a letter written by a community member to the Mayor asking what the process was as the neighborhood became aware that there is apparently a number of registered sex offenders who may be living in the Monticello area. . Background on this item, I have had a conversation with Bill Donay of the Department of Corrections who has provided me with a little background on the different types (levels) of sex offenders and the notification procedures that are being used today. First of all, there are apparently three levels of sex offenders with level one being the least likely to offend in the future; level two being a moderate likelihood of a recurrence and level three being the most likely to offend in the future. The Department of Corrections provides details to the local sheriff s department or police department by assigning a risk level to a sex offender based on one of the above three categories. With a level one offender, it is my understanding that the sheriffs department may notify the victims from previous incidents or the witnesses and law enforcement agencies in the area but that is the extent of the notification. For a level two offender, the sheriffs department would also notify businesses or agencies in the area including schools, daycare facilities and other areas or locations where a sex offender might find a victim. For an individual identified as level three offender, the sheriff's department has authority to inform the entire community which can be done in a number of ways including a community meeting or by notifying local officials and also through newspaper articles that the offender would be living in a certain community. It is my understanding that the sheriffs department has restrictions on how many people they can notify regarding a level one or two offender and that they are not able to give out a lot of information to the general public regarding these levels of individuals. The only authority they have to actually notify the public through the various methods noted was for a level three offender. . Hopefully the sheriffs department will provide additional background information on this memo to correct any errors I may have in the process, but this is my understanding from talking to the Department of Corrections official. The individual that first brought this issue to the attention of Mayor Herbst is looking for the creation of a public informational meeting, similar to what the Police Commission did with the meth problem recently, that would have law enforcement officials, Department of Corrections officials, and possibly the Wetterling Foundation representatives in attendance to inform the public of the different types of offenders that may be in a community and the legal notification requirements that law enforcement has to comply with. This individual is not necessarily looking for specific information on actual individuals but more of a process that is being used so that the public understands when they may be notified or why they are not being notified of certain sex offenders being in our community. As we all know, there are a number of rumors that get started and apparently there are some rumors going around regarding the half-way house that is in Monticello where a number of level two sex offenders are currently living together near schools without neighborhood residents even being aware it exists. I thought this would provide some background information for commission members and sheriffs department as to what type of discuss may take place at our Police Commission meeting and the purpose of the discussion. . . Enclosed you will find a brief agenda that is being sent to the Police Commission members for a meeting to be held Wednesday, May 17, 2006 at 7 p.m. to discuss a few traffic issues regarding traffic control devices in a couple locations in Monticello and also to briefly review how Walt's Pawn Shop has been operating in regards to a license renewal. Any statistical updates that the Sheriff's Department would like to present to Police Commission members should be brought to the meeting for distribution and if there are any other updates you would like commission members to be aware of, it would be appreciated. In regards to the Walt's Pawn Shop issue, I have given the commission members a copy of the report that Dave Clemons prepared for our April 24, 2006 Council meeting, but ifthere is additional information you would like to share with the Police Commission members about his operation, please provide that information also at the meeting. I realize that the Sheriff's Department may have not had an opportunity to do much more enforcement activities with Mr. Thompson at the pawn shop, but I think the City Council is going to want to know how the Sheriff's Department feels he is operating and whether he is making efforts to comply with the city ordinances, especially with your concern of not recording merchandise that is confiscated by other agencies. I think the City Council takes this as a serious violation and is going to be looking to the Sheriffs Department for a recommendation on whether the license should be considered for revocation or whether it should be continued. After you have had a chance to review the agenda, if you have any thoughts or opinions on the two traffic control issues that are on the agenda, feel free to share that information with the commission members also at the meeting. Since we haven't been meeting very frequently, hopefully Sheriff Miller will be able to attend our Police Commission meeting also.
