The meeting was call to order at 7 p.m. and a quorum was present.

Review and discussion of Groveland Park survev results.
Commission members and Sheriffs Department representatives were presented with a
summary of the Groveland Park survey results that noted some of the concerns neighborhood
residents had expressed on the development and activities in Groveland area parks.
Commission members discussed that recently concerns had been raised by an adjoining
property owner that questions the development plans the City had for recreational facilities in
the Groveland Park due to fears of excessive noise and unruly behavior of kids activities in the
parle Sheriffs Department representatives noted that they had not received any serious
complaints fi-om area residents on park activities, but noted they typically will try to monitor a
location if they receive a number of complaints.
4. Review of enforcement activities done bv Sheriff's Deoartment in coniunction with state
snowmobile e:rants.
Lieutenant Anselment presented commission members with a summary of the 2003-2004
recreational activities that Sheriffs Department personnel have done throughout Wright
County regarding snowmobile and A TV enforccment. Mr. Anselment noted that
approximately $769 in labor costs were expended in the Monticello community for
snowmobile enforcement activities. The Sheriff s Department planned on using the
remaining funds hom a $1.000 grant towards purchasing additional equipment. such as a
snowmobile trailer for transporting snowmobiles next season.

Review of ATV use in eitv Ilad,s.
Sheriffs Department representatives noted 10 commission members that A TV usage by
juveniles and adults have increased substantially throughout Wright County and also in
Monticello. It was noted that there had been concerns by some deputies that it was diJ1]cult to
deal with juveniles who operate A TVs unlawfully as it is normally di f1lcult to actually cite or
ticket juveniles under the age of I ] for operating A TV s without a license. The Sheriffs
Department and County Attorney's office has supported ticketing parents for allowing minor
children to operate A TVs without a license as an alternative method to actually ticketing the
driver. Overall, it was noted that the City's current ordinance prohibiting recreational vehicles
in park locations was an adequate prevention too] that the Sheriffs Department will use in the
future.

Update bv Sheriff's Dellat"tment on activities for last Quarter.
Sheriff Depm1ment representatives provided to commission members a copy of the annual
report for the year 2003 showing calls for service, including number of accidents, traffic
citations and various crime activities. Sheriff Department representatives felt that with the
recent increase in the patrol hours contracte~ for. the current 48 hour daily coverage seems to
be beneficial in providing a good level of se,.vice and also in keeping the response time at an
appropriate level. Depending on how anne),jation proceeds with Monticello Township, the
City may have to look at additional hours being added to the coverage for the 2005 budget
year.

Discussion on School Boulevard speed limits and oedestrian crosswalk locations.
A. REFERENCE AND BACKGROUND:
Recently the City Council was approached by a resident along School Boulevard
expressing concerns about excessive speeding along School Boulevard from TH 25 to
County Road 18, especially in the area of the school facilities. Questions were raised by
the citizen as to why the speed limit was 45 mph in an area near schools and cited
incidences where cars and trucks were actually honking their horns at children crossing
School Boulevard. Although I am not sure of the exact location of where these crossings
may have occurred, if they were taking place in a marked pedestrian crosswalk, this
would seem unusual.
With the development that is occurring along School Boulevard near TH 25, traffic
volumes are expected to increase on this route. Originally when the speed limit was
established, I believe MnDOT performed a traffic speed study that indicated the area
seemed to support a speed limit of 45 mph, as this is the speed that is typically driven on
a major thoroughfare of this caliber. As some of you may recall, a lot of times the speed
limits are established based on what speed vehicles are normally traveling, not just on the
wishes and desires of neighbors. Ifthe road is wide open and straight, traffic will
generally drive at what is termed to be a reasonable speed and that is what the state uses
most often in establishing a safe speed limit. In regards to the speed limit near the school,
signs are posted that indicate the speed limit is lower (30 mph) when children are present.
The question for Sheriff Department representatives and Police Commission members is,
should a new speed study be requested from MnDOT to see if the current speed is
appropriate, and if it still is, should additional enforcement action be recommended by the
Sheriff s Department to control speed limits in that area.
Along the same lines, questions have also been raised as to why School Boulevard is
posted at 45 mph while another major route, Chelsea Road, from TH 25 eastward through
the industrial park, is only posted at 30 mph. In some cases, it appears that traffic should
actually be going faster on Chelsea Road through an industrial area than it would be
allowed to do in a residential/school area, but the speed limit postings are just the
opposite. Is this another area that should be studied and if so, a recommendation can be
made to the City Council on both of these areas to be reviewed as needed.

Review of City's snowbird ordinance enforcement.
A. REFERENCE AND BACKGROUND:
The Monticello Public Works Department had previously received complaints from
citizens regarding being ticketed for parking vehicles on the street overnight (when there
is no snow) and then during a snowfall, they've noticed other vehicles parked in the
streets not being ticketed and the snowplow drivers are plowing around these vehicles.
I believe this information has been passed along to the Sheriff s Department by the City's
Public Works Director asking the Sheriffs Department to enforce the ordinance
uniformly. The individuals complaining were likely justified in receiving a parking
citation, but it also looks bad when we aren't applying the ordinance uniformly across thc
City at other times.
Possibly Shcriff s Department representatives will have some information or statistics
that will address the enforcement procedures that are being used or they may be able to
enlighten the commission membcrs as to why it is difficult to enforcc this ordinance. It
may have been simply an ordinance that not all deputies that service Monticello were
awarc of and once they were informed of the City's desire to enforce the snow removal
policy, the issue has been resolved.
Other than to discuss this item, no specific action is requested at this time.

ACT ADOPTED; PENAL TIES: The regulatory provisions of Minnesota Statutes] 96] ,
Chapter 169. as amended are hereby adopted as a traffic ordinance regulating the use of
highways. streets, and alleys within the city of Monticello and are hereby incorporated in
and made a part of this ordinance as complete as if set out here in fulL
Any \'iolation of the statutes adopted by reference in Section 9-1-1 is a violation of the
ordinance when it occurs within the city of Monticello. Any person thus violating any
provision of this ordinance shall be guilty of a misdemeanor and upon conviction shall be
punished not more than the maximum penalty for a misdemeanor as prescribed by state
1m\'.. If a minimum fine or imprisonment is prescribed by the State Highway Traffic Act
for the offense or if such offense be classified as a petty misdemeanor. such penalty
and/or classification shall apply to a person convicted of the same offense under this

PARKING AND STOPPING: It shall be unlawful for the owner and/or driver of a
motor vehicle to stop. stand. or park the said vehicle in any of the following places.
except when necessary to avoid conDict \\lith other traffic or in compliance with the
directions of a peace officer or traffic control devices:
(A) On a sidewalk or boulevard between sidewalk and roadway,
(8) On a crosswalk,
(C) Within an intersection,
(D) Within twenty (20) feet of a crosswalk at any intersection,
(E) Within ten (]O) feet ofa lire hydrant.
(F) Within thirty (30) feet of any arterial stop sign or sign indicating the direction for

On the roadway side of any vehicle stopped or parked at the edge or curb of a
street or highway.
At any place where officiall signs prohibit stopping, standing, or parking.

9-1-3:
REMOVAL OF VEHICLES: Whenever any police officer finds a motor vehicle has
been parked or stopped in violation of any regulation contained herein, such officer is
hereby authorized to move such vehicle, provide for the removal of such vehicle and the
impounding of the same, or require the driver or other person in charge of the vehicle to
move the same. Any such removal and/or impounding of the said vehicle shall be at the
expense of the owner.

OWNER: For the purposes of this section, the term "owner" shall mean the person, firm,
or corporation who holds legal title on the date of any alleged violation as evidenced by
the official records of the Minnesota Secretary of State. Copies of any of the files or
records of the Secretary of State certified as being true copies shall be received in
evidence with the same force and effect as the originals, shall be admissible without
further foundation, and shall be prima facie evidence as to the ownership of the said
vehicle, but nothing herein contained shall exclude or prohibit the introduction of other
evidence bearing on the issue of ownership.

PROTECTION AND PRESERVATION OF CITY STREETS:
(A) TRACTORS OR OTHER TYPES OF VEHICLES WITH LUGS: Tractors or
other vehicles with lugs thereon or any other type of farm machinery that is not
equipped with rubber tires are hereby prohibited from using said bituminous
treated streets or parking lots in said city; and whoever drives such a vehicle upon
said streets whereby said streets or parking lots shall be damaged shall be guilty
of a misdemeanor.

LOAD LIMITS ON CITY STREETS OR PARKING LOTS: It shall also be
unlawful for any person or persons, firm or corporation to drive any vehicle over
said streets or parking lots having an axle weight load in excess of five (5) tons
during periods of the year when county road restrictions are not in effect. During
periods of county road restriction or on streets designed for more than jive tons,
the current city street desig~ map adopted oy the City Council shall take
precedence over the five (5j ton limit and can be more or less restrictive. That any
person, firm or corporation wishing to drive such vehicles in excess of aoove
mentioned weight over any of the streets oflVlonticello shall first apply to the City
Administrator for his permission. That the City Council may designate certain
streets to be used regularly oy such persons, firm, or corporation in the operation
of their business, outlining certain routes that said vehicles are to follow and that
no deviation ji'om such routes will be permissible,

(C) TRUCKS OPER.A.TING ON RESIDENTIAL STREETS: It will be unlawful for
any person or persons, firms or corporations to operate a truck of over 9.000
pounds gross weight on residential streets except those trucks that are actually
engaged in making deliveries or pickups at residential dwellings. Further, they
will utilize state highways or designated truck routes wherever possible when
making these deliveries or pickups, All other truck traffic not making deliveries
or pickups will utilize only state highways or designated truck routes. Trucks
making deliveries or pickups on residential streets will adhere to the provisions of
paragraph 9-1-5 (B).

PENAL TY: Any person violating any provision of this ordinance is guilty of a
misdemeanor and upon conviction shall be punished not more than the maximum

Monticello, except when an emergency creates the necessity for such operation. is
prohioited.

Exhibition Driving - No person shall drive or operate a motor vehicle upon any
public highway. street. parking lot. alley. or other public property \\ithin the limits
of the city of Monticello which causes unnecessary engine noise or backfire. nor
shall anyone between the hours of 7:00 p.m. and 7:00 a.m. parade a motor vehicle
upon any public highway. street. parking lot. alley. or other public property within
the limits of the city of Monticello.
Parade a motor vehicle is hereby defined as driving or operating a motor vehicle
up. down. or up and down. the same highway. street. parking lot. alley. or other
public propeny more than three times within a thirty-minute period.
(D) Penalties -Any person violating any pro\ision of this ordinance is guilty of a petty
misdemeanor and upon conviction shall be punished not more than the maximum
penalty as prescribed by state law.

P ARKTNG IN REGARD TO SNOW PLOWING AND/OR REMOVAL: After a
snowfall. all streets in the city of Monticello shall be cleared of all motor vehicles and
parts thereof for the purposes of snow plowing and/or removal until all streets are
plowed.
Any motor vehicle or parts thereof left on any street or boulevard in the city of
Monticello in such a way as to impede the performance of the city and/or state snowplow
shall be dealt with under the Penalty Code No. 1-4-1.

TOWN HOMES:
Town home developments are occurring in all the major growth cities in Wright
County. The town home developments of the 1970s did have their share of
problems in the cities of St Michael and Albertville. Many of these attached units
were rentals rather than owner occupied.
Today's town home developments appear to be owner occupied (as well as some
rentals) with homeowner associations. Some of these associations do an excellent
job of self-rule (contracted lawn and snow removal service as well as repair
service). These services are generally funded through association dues paid by
the individual homeowners. The advent of maintenance-free exteriors have
assisted in maintaining aesthetics.

In Monticello, the high number of apartment buildings, many of which are
subsidized, have been the source of many calls for law enforcement services.
Subsidized buildings, if managed well by on-site competent managers or
caretakers can be safe and pleasant places to live. However, many residents and
neighbors have had poor experiences with some of these buildings due to a high
amount of criminal activity. This isn't specific to Monticello however. This has
occurred in Albertville, Rockford, Cokato, Buffalo and Clearwater as well. If the
criminal element is allowed to remain in a building unchecked as residents or
visitors, the quality of life in the building and neighborhood deteriorates and
presents a great challenge for law enforcement and the municipality.
Working together with cities, managers, tenants, neighbors and the Sheriff's
Office has proved to be an effective method of controlling some of our historical
problem properties. Cooperation from the building management/caretaker is
key however. We have many examples of buildings in Wright County that have
"turned around".

Re: "Snow Bird" Ordinance Enforcement
Dear Mr. Miller:

The Monticello Public Works Department has been receiving complaints from citizens regarding being ticketed
for parking vehicles in the street overnight (when there is no snow) and then during a snowfall, they've noticed
other vehicles parked in the streets not being ticketed and the snowplow drivers are plowing around these
vehicles. We have informed these callers that the ordinance states that there is no parking allowed on any city
street between the hours of2 a.m. and 6 a.m. effective November 15 through April 15. Therefore, even though
it may seem unfair to them, they were in fact in violation of the city's ordinance and, thus, appropriately ticketed.
We also informed them that we would inquire why the sheriff's department was not ticketing or towing all
vehicles in violation during inclement weather.
While we appreciate your enforcement of this ordinance, we feel there is not enough effort put forth from the
deputies during snow or ice storms to rigorously enforce this ordinance. Our plow drivers had to plow around
at least 20 vehicles during the last snow event. These vehicles should have been ticketed and towed at 2 a.m. to
enable our plows to clear the streets efficiently and safely. I am requesting that you ask the deputies patrolling
Monticello to make the extra effort to clear the streets of illegally parked vehicles and uniformly enforce the
ordinance and policy. A copy of the City's Snow PlowinglRemoval Policy and a copy of City Ordinance Title 9,
Traffic Regulations are enclosed for your review.

Update by Sheriffs Department on Activities for the last six months for
April 20, 2005 Police Commission Meeting
Enclosed you will find a brief agenda that is being sent to the Police Commission members for a
meeting on next Wednesday, April 20'h at 7 p.m. to discuss a few traffic issues regarding speed limits
along a couple of corridors in Monticello and to update the Commission members on any new
activities or problems the Sheriffs Department may have been experiencing in Monticello.
As you know, we haven't met very often during the past year and I think it would be good for
SheritT s Department representatives to provide some statistical information on service calls,
patrolling activities and enforcement procedures and any other issues that might be appropriate for
Police Commission members to discuss. The fact that city staff does not receive many complaints on
our service coverage means the Sheriff s Department is doing a good job, but] think it is good for the
Police Commission members to be updated on what the Sheriffs Department sees as concerns as the
City of Monticello continues to grow.
A hot issue for the Planning Commission and City Council has been the developers desire to build
numerous townhomes in the City at various developments. There seems to be some concern by
COLmcil and Planning Commission members along with Fire Department personnel that townhouse
developments are prone to create neighborhoods that may be conducive to criminal activities in the
future and will do nothing but cause problems dovvn the road for communities like Monticello. It
might be interesting to hear comments or concerns from Sheriff s Department personnel regarding
these types of development pressures, or if you do not feel this type of development causes problems
for Monticello, that information would also be appropriate to relay to commission members.
