City Council Resolution 2022-119CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA RESOLUTION NO. 2022-119 APPROVING AN ADJUSTMENT TO A PLANNED UNIT DEVELOPMENT AND AMENDMENT TO DEVELOPMENT CONTRACT FOR TWIN PINES FIRST ADDITION PLAT AND PLANNED UNIT DEVELOPMENT WHEREAS, the developer has requested the transfer of the Development Contract for plat and Planned Unit Development for Twin Pines First Addition, to which the property owner has consented; and WHEREAS, the developer proposes an adjustment to the PUD District approvals by modifying the number of units from 93 to 96 units in the multi -family use; and WHEREAS, the applicant proposes to continue the development of the property for residential uses and parking and access associated with the planned unit development, including cross access and parking with adjacent existing uses, and no other changes to development design or common operations would occur; and WHEREAS, the site is guided as "Commercial -Residential Flex" in the City's Comprehensive Plan; and WHEREAS, the proposed PUD adjustments, are consistent with the long-term use and development of the property for commercial and residential mixed uses; and WHEREAS, the City Council has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the City Council of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: 1. The PUD Amendment provides an appropriate means of furthering the intent of the Comprehensive Plan for the site by putting the existing and proposed buildings to within the PUD to a mix of residential and commercial uses. 2. The proposed improvements on the site under the PUD Amendment are consistent with the needs of the development in this location as Commercial - Residential Flex area. 3. The improvements are not expected to impact public services, including sewer, water, stormwater treatment, and traffic which have been planned to serve the property for the development as proposed. 4. The modifications to the building designs as proposed with this amendment are consistent with those previously approved and will provide for a higher level of building aesthetics and other benefits. CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA RESOLUTION NO. 2022-119 5. The PUD flexibility for the project, including parcels without public street frontage, are consistent with the intent of the City's economic development objectives, as well as with the intent of the PUD zoning regulations. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello, Minnesota, that the Monticello City Council approves the PUD Adjustment for the Twin Pines First Addition Planned Unit Development subject to the conditions listed in Exhibit Z of the staff report as follows: 1. The development of Twin Pines First Addition is subject to all conditions and comments assigned with the Development Stage PUD and Preliminary Plat approval of December 7, 2021 and the Final Plat and Final Stage PUD Approval of February 28, 2022. 2. The applicable plans dated 10/7/2022, subject to resolution of conditions and comments, shall control the project's use, development, site design, and are incorporated into the PUD District adopted for the subject property. 3. The Developer shall execute the Plat and PUD Development Contract for Twin Pines First Addition, providing for the terms and conditions for the development. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA, that the amended document titled "Development Contract and Planned Unit Development for Twin Pines First Addition" with assignment of the specific terms and conditions for public improvements , including the transfer of the contract to Apartments Monticello LLC, and the specific terms and conditions for plat and PUD development, is hereby approved.
