At a recent City Council meeting, concerns have been expressed by citizens
on the enforcement procedures being used by the City to regulate snowmobile
activity. With the large amount of snow that has accumulated this season,
there seems to be an increasing number of snowmobiles, and along with that,
complaints from property owners regarding snowmobile activity. In this
regard, the City Council will soon be discussing whether the City should
tighten up its snowmobile ordinance indicating where snowmobiles can run,
or whether the City has to look at ways of providing more enforcement
through the Sheriffs Department or other means to apprehend violators, or
whether the City should simply ban snowmobiles entirely within the city
limits.
Since our committee has not met for a few months, I thought this would be a
good topic that we could discuss amongst ourselves and also get input from
the Sheriff's Department regarding enforcement procedures they, could help
us with. Possibly the City Council will be requesting that an all-out effort be
conducted to stop and ticket snowmobile operators who violate the city
ordinance, as it is believed that the word would travel fast if this was done.
I've enclosed a copy of our present snowmobile ordinance so that you can get
a feel for what the language currently is, and possibly you can be prepared
with some suggestions for amendments if warranted. The basic intent of our
current ordinance is to limit operation of snowmobiles to no later than
11 p.m. weekdays or 1 a.m. weekends and prohibit operation within 300 f~ of
any residence. Also the snowmobiles are not allowed to operate for
recreational use and should only be traveling within the city for the purpose
of traveling to and from the operator's residence in a direct route. I realize
this language can be very vague and hard to regulate. It will be interesting
to get the input from the Sheriffs Department as to how they handle
snowmobiles in other areas of Wright County and whether other
municipalities have mare lenient or stricter ordinances than Monticello.
After reviewing and discussing the ordinance and possible revisions, any
recommendations can be brought Forward to the City Council for their
consideration.

Council.
Commission members discussed the recent approval by the City Council to
add 200 additional hours to the police protection coverage total for the year
1997. It was noted that some discussion was held by the City Council on
whether a specific schedule should be provided by the Sheriffs Department
concerning when the additional hours would be used. Commission members
were again informed by Chief Deputy Don Lindell that the Sheriffs
Department would still rather have the flexibility of scheduling the
additional hours throughout the year on an as-needed basis to combat
specific problems that may arise during the year rather than setting a
schedule in advance. Mr. Lindell noted that it certainly would be possible to
simply add one shift on particular days during the month, but the
department feels it would be more beneficial to the City of Monticello if the
department was allowed to add the additional shifts as problems arise.
It was suggested by Mr. Lindell that the Sheriffs Department would indicate
monthly when the hours were used and for what specific purpose or reason
they added the extra shift. This would provide the City with statistical data
to determine the success of the additional hours and to possibly substantiate
the need for adding additional hours in the future.
It was recommended that the City Council be updated an the Police
Commission's recommendation that the additional hours not be set in
advance but be determined by the Sheriffs Department as needed
throughout the year.

Commission members briefly discussed the recent rash of carbon monoxide
alarms that involve calls to the police department resulting in responses from
the fire department to investigate. It was noted that the Wright County Fire
Chiefs Association has recommended the Sheriffs Department establish a
policy of not automatically calling the fire departments for each carbon
monoxide inquiry but investigate as to whether the individual caller
shouldn't be contacting the gas company first. It was noted by Chief Deputy
Lindell that the Sheriff's Department is well aware of the large number of
carbon monoxide calls that have been occurring and agrees that local fire
departments should not automatically be required to respond to every call
concerning these alarms.

6-5-1: DEFINITIONS:
(A) owm biles: As used in this ordinance, a snowmobile is defined to
mean aself-propelled vehicle designed for travel on snow or ice or a
natural terrain steered by wheels, skis, or runners.
(B) Commissioner: As used in this ordinance, Commissioner means the
Commissioner of Department of Natural Resources, State of
• Minnesota.
(C) Person: As used in this ordinance, person includes an individual,
partnership, corporation, the state and its agencies and subdivisions,
and any body of persons, whether incorporated or not.
(D) Owner: As used in this ordinance, owner means a person other than a
lien holder having the property in or title to snowmobile, entitled to
use, ar possession thereof.
(E) Operate: As used in this ordinance, operate means to ride in or on and
physically or constructively control the operation of a snowmobile.
(F) 9~ra~x: As used in this ordinance, operator means every person who
operates or is in actual physical or constructive control of a
snowmobile.
(G) Road~X: As used in this ordinance, roadway means that portion of a
highway improved, designed, ar ordinarily used for vehicular travel,
including the shoulder.

(H) As used in this ordinance, street or highway
means the entire width between boundary lines of any way or place
when any part thereof is open to the use of the public, as a matter of
. right, for the purposes of vehicular traffic.
(I) - As used in this ordinance, right-of--way means the
entire strip of land traversed by a highway or street in which the
public owns the fee or an easement For roadway purposes.
(J) As used in this ordinance, safety or
deadman throttle is defined as a device which, when pressure is
removed from the engine accelerator or throttle, causes the motor to be
disengaged from the driving track.
(K) ~~: Meandered lakes which are under the jurisdiction of the
Commissioner of the Department of Natural Resources, State of
Minnesota.
6-5-2: RESTRICTIONS: It is unlawful for any person to operate a snowmobile:
(A) Between the hours of eleven o'clock (].1:00) p.m. and seven o'clock
(7:00) a.m. within three hundred feet (300') of a residence, except that
on Friday and Saturday nights and evenings preceding Thanksgiving,
Christmas, and New Year's the hours shall be one o'clock (1:00) a.m, to
seven o'clock (7:00) a.m.

(C) Snowmobile Operation Speed Limit: At a rate of speed greater than
reasonable, prudent, or proper under all the surrounding

endanger or be likely to endanger any person or property or to cause
injury or damage thereto.

travel.

(H) Snowmobiles s1~11 obey all city and state traffic laws when operating
vehicles on city streets.
• 6-5-3: PROHIBITED AREAS: It shall be unlawful to operate snowmobiles in the
following areas:
No person shall operate a snowmobile upon the roadway, shoulder, or inside
bank or slope of any city trunk, county state-aid, or county highway in this
city and, in the case of a divided trunk or county highway, on the right-of-
way between the opposing lanes of traffic, except as provided in this
ordinance, nor shall operation on any such highway be permitted where the
roadway directly abuts a public sidewalk or walkway.

No person shall operate a snowmobile within the right-of=-way of any trunk
city, county state-aid, or county highway between the hours of one-half (1/2)
hour after sunset to one-half (1/2) hour before sunrise, except on the right-
hand side of such right-of--way and in the same direction as the highway
traffic on the nearest land of the roadway adjacent thereto. No snowmobile
shall be operated at any time within the right-of--way of any interstate
highway or freeway within this city. The provisions of this section shall not
apply in the case of emergency when any street is impassible by other motor
vehicles.
6-5-4: AGE RESTRTCTTON: Notwithstanding anything in this ordinance to the
contrary, no person under fourteen (14) years of age shall operate a
snowmobile on city streets or make a direct crossing of a city street, trunk
county state-aid, or county highway as the operator of a snowmobile. A
person fourteen (14) years of age or older but less than eighteen (18) years of
age may operate a snowmobile on streets as provided by this ordinance and
may make a direct crossing of a city street, trunk county state-aid, or county
highway only if he has in his immediate possession a valid snowmobile safety
certificate issued by the Commissioner.
6-5-5: UNCONTROLLED INTERSECTIONS: No snowmobile shall enter any
uncontrolled intersection without making a complete stop. The operator
shall yield the night-of--way to any vehicle or pedestrian at the intersection or
so class to the intersection so as to constitute an immediate hazard.

6-5-6: EQUIPMENT: All snowmobiles shall have the following equipment:
(A) Standard mufflers which are properly attached and in constant
operation, and which reduce the noise of aperation of the motor to the
minimum necessary for aperation. Mufflers shall comply with
Regulations CONS 55, which is hereby adopted by reference as it
existed on September 1, 1970. No person shall use a muffler cutout,
bypass, straight pipe, or similar device on a snowmobile motor, and the
exhaust system shall not emit or produce a sharp popping or crackling
sound.
(B) Brakes adequate to control the movement of and to stop and hold the
snowmobile under any conditions of operation.
(C) A safety or so-called "deadman" throttle in operating condition so that
when pressure is removed from the accelerator or throttle, the motor is
disengaged from the driving track.
(D) At least one clear lamp attached to the front with sufficient intensity
to reveal persons and vehicles at a distance of at least one hundred
feet (100') ahead during the hours of darkness under normal
atmospheric conditions. Such head lamp shall be so aimed that
glaring rays are not projected into the eyes of an oncoming vehicle
operator.
It shall also be equipped with at least one red tail lamp having a
minimum candlepower of sufficient intensity to exhibit a red light
plainly visible from a distance of five hundred feet (500') to the rear
during the hours of darkness under normal atmospheric conditions.
The equipment to be in operating condition when the vehicle is
operated between the hours of one-half (1/2) hour after sunset to one-
half (1/2) hour before sunrise or at time of reduced visibility.
(E) Reflective material at least sixteen (16) square inches an each side,
forward of the handlebars, so as to reflect a beam of light at a ninety
(90) degree angle.
6-5-7: COMPLIANCE: It is unlawful for the owner of a snowmobile to permit the
snowmobile to be operated contrary to the provisions of this ordinance.
6-5-8: VIOLATION: Any person violating the terms of this ordinance shall, upon
conviction, be guilty of a misdemeanor.

Snowmobile complaints, accidents and fatalities have been an
all too common concern this winter. Early snows and increasing
numbers of snowmobilers have contributed to a mounting problem.
The Wright County Sheriff's Office has been looking at the problem
and searching far ways~to reduce the number of complaints and
promote safety.
Sheriff Don Hozempa reports that since the beginning of snow
cover this winter from mid November through January 23, 1997 the
Wright County Sheriff's Office has received 106 snowmobile
complaints. Approximately one half of these complaints were for
trespassing and about one third were for various other law
violations. Five communities (Cokato, Monticello, Otsego, Rockford
and St. Michael) have reported nearly one half of all complaints.
There have been 27 snowmobile accidents reported in the county
including one fatality. Mare than half of the accidents occurred
at night.
In response to the complaints Sheriff Hozempa has increased
snowmobile enforcement and deputies have-been working the trails
and giving warnings or citations to violators.
Excess speed is often a factor in many of the snowmobile
accidents. The maximum legal speed for a snowmobile is 50 miles
per hour, or the pasted limit, whichever is lower. The sheriff
cautions that you keep in mind, however, that current conditions of
the trail, the terrain and visibility may call for reduced speeds.
This is especially true at night. Studies indicate that at night
if you are driving faster than 40 mph you are probably over-driving
your headlights. At speeds over ~0 mph by the time you can see an
obstacle in your headlights it is too late for you to stop.
Combining speed with anY use of alcohol and you have the potential
for some deadly results.
Sheriff Hozempa suggests that his staff would like to work
together with cities, townships, and the Wright County Snowmobile
Association to get the word out on the state laws and local
ordinances so that people are better informed of what they can and
cannot da. The sheriff feels that at least some of the violations
may occur because snowmobilers do not know what is required of
them. To help correct this problem the sheriff's office has put
together a one page information sheet with a summary of the state

statutes and some safety rules along with a summary of Wright
County city snowmobile ordinances. These information sheets will
be posted at various locations where snowmobilers often stop and
will be available far distribution.
Since 1981 the Wright County Sheriff's Office has offered
snowmobile safety classes. Classes are open to Wright County
residents and are held an the second Saturday of the month in
December, January and February. Class size is limited to 125
persons and is open to young people and adults. Students must pre--
register at the sheriff's office and pay a $5.00 fee.
Wright County has more than 250 miles of groomed snowmobile
trails. These trails either go through or pass by nearly every
city in Wright County. Sheriff Hozempa offers that the sheriff's
office is willing to assist the local snowmobile clubs, and the
cities to work together to improve and establish well-marked
designated routes through the cities and along the trailways
throughout the county. We need to work together to promote
personal safety and reduce the number of complaints.
The most common snowmobile complaint reported to the sheriff's
office is for trespassing. Sheriff Hozempa warns that snowmobilers
should be aware that they need permission to ride on any
agricultural land ar any legally posted privately owned Land.
The only place a snawmobiler can legally ride without
landowners permission is within the road right of way (33 feet to
75 feet from the center of the roadway depending on the road
classification), in the ditch or outside slope of the ditch, or an
designated trails. Snowmobilers who trespass may receive a
criminal or civil citation for violating the state trespass laws.
Penalties may include a fine of up to $700, a jail sentence of up
to 90 days and a loss of your machine's registration and your
privilege to drive a snowmobile for one year. Continued violations
will likely lead to more posted land, possible trail closings, or
further prohibited use within city limits.
Landowners should post any non-agricultural land if they do
not wish to allow snowmobiling (trespassing, hunting, etc.). The
signs must be placed once each year, state the restricted activity
(na trespassing etc.), have at least two inch letters, be signed by
the owner, occupant, lessee or manager or displayed with the name
and phone number of the owner, occupant, lessee or manager. The
signs must be placed every 1000 feet an clear boundaries, every 500
feet on obscured boundaries, or at the primary corners and at the
entrance roads and trails.
Lawmakers are already proposing an increase in registration
fees to pay for improved safety, education and improved trails.
Using common sense, courtesy and respect far others will allow the
sport to continue without overly restrictive laws. By working
together we can make this a safe sport far all to enjoy.

Your safety and the fuwre of snowmobiling in the state and your community will be determined by your driving behavior. Each
year the Wright County Sheriffs Oflice receives numerous complaints of snowmobile drivers trespassing and disobeying the law. Often
it is only a small percentage of the riders who are causing problems. And some of this behavior may be due to an ignorance of the law.
For your convenience we have put together a summary of selected snowmobile stawies that you should be familiar with. For a more
complete listing please refer to [he current Minnesota Snowmobile Safety Laws, Rules and Regulations. On the other side of [his sheet you
will find a summary of the current snowmobile ordinances for Wright County Cities.

Summary of Selected Snowmobile Statutes
-You must display current registration.
-Maximum speed of 50 mph or the posted limit, whichever is lower. To further increase safety reduce speed at nigh[ and for
adverse weather and trail conditions.
-NO travel on the roadway, shoulder, or Inside slope of the roadway of state and county highways, the meridian of four-lane
highways, or the tight of way of any interstate highway.

-Maintain a safe distance between riders.
-Between one half hour after sunset to one half hour before sunrise you must drive in the same direction as highway traffic.
During daylight hours, riders may travel in either direction.
-Come to a complete stop before crossing a public roadway and yield to all oncoming traffic.
-Cross public roadways at a 90 degree angle. Cross a divided highway only at an intersection.
-Persons under 1$ years of age must have a valid Snowmobile Safety Certificate and are subject Lo other restrictions as outlined
in the Minnesota Snowmobile Safety Laws, Rules, and Regulations.
-In general you may not cross private land without permission of the landowner. Trespassers will be subject to civil or criminal
penalties.
-On township roads you may drive on the extreme right hand side of the roadway when not otherwise restricted.
-A snowmobile may be operated on a bridge to avoid obstructions to travel when absolutely necessary. Keep to the extreme
right hand lane and cross without delay.
-When traveling on county trails be sure to stay on the marked trailway.
-Avoid frozen lakes and streams unless you are certain of their condition and safety and you have legal access.
-You m_ ay not ride a[ airports, state parks, state recreation areas, historic sites, wildlife management areas with the exception of
pasted trails.
-If your blood alcohol content exceeds the legal limit of .10, you will be charged with snowmobiling under the influence and
subject to a fine and loss of your snowmobile driving privilege.
