RE: Quarterly meeting date--November 16, 1994, 7 p.m.
Enclosed you will find a brief agenda for our next quarterly meeting, which is scheduled
for November 16 at 7 p.m. (Wednesday). if any Commission member has any other topic
that you would like to see addressed at this meeting, I'm sure we will have time to
discuss other items of interest.
The only real item that is on this agenda concerns the possibility of asking the City
Council to establish an ordinance that regulates where rollerblades, skateboards, and
other similar devices can be used within the city limits. Based on information from the
last meeting, a preliminary ordinance was drafted based on the City of Lakeville's
ordinance that primarily regulates skateboarding and rollerblading as follows:
1. Eliminates skateboarding and similar type activities from a defined central
business district on any sidewalk, street, or other public parking lot located
in the central business district.
2. Also prohibits skateboarding, etc., on private property without the expressed
permission of the property owner.
This may be something we want to discuss as to whether we feel it's
• necessary for the City to regulate what takes place on private property or
whether we should just leave it up to each property owner to determine.
3. On any state highway in the city. Far this purpose, the only state highway
would be Highway 25.

Since our last meeting, I also asked the Parks Commission to give us their opinion as to
whether they feel it's necessary for the City to have this type of regulation affect our new
pathway project and trailway system within the city. At this point in time, the Parks
Commission does not want to recommend an ordinance be adopted prohibiting
skateboarding or rollerblading on our future pathways, as it may not become a problem,
and it may be a good location for this type of activity to take place. Parks Commission
feels that the proposed newly-constructed pathways may be sufficient in width to allow
both pedestrians and use far rollerblading, etc., but they would always want to keep their
option open if it does become a problem in the future.
If the Police Commission feels this type of ordinance should be presented to the City
Council for adoption, we will need to define what we consider the central business district
if you wish to prohibit all usage on sidewalks, streets, and parking lots within the central
business area. As this ordinance is written, skateboarding on other sidewalks throughout
the city would still be allowed, and the intent would be to regulate only a specific area
where it is more densely populated or problems could exist.

BE AMENDED BY ADDING THE FOLLOWTNG CHAPTER RELATING TO
SKATEBOARD AND ROLLERBLADE USE:
CHAPTER 10
AN ORDINANCE RELATING TO THE REGULATION
OF SIDEWALKS AND STREETS, PROHIBITING THE USE
OF DEVICES KNOWN AS SKATEBOARDS, ROLLER SKATESBLADES,
AND SCOOTERS ON SIDEWALKS AND STREETS
IN THE CENTRAL BUSINESS DISTRICT OF
THE CITY OF MONTICELLO

$-10-1: DEFINITIONS: The following words and terms, whenever they occur
in this ordinance, are defined as follows:
(A) CENTRAL BUSINESS DISTRICT means the area of the city bounded by
the following lines:

(B) ROLLER SKATESBLADES means a shoe with wheels attached ar a device
with wheels which is designated to be attached to a shoe.
(C) SKATEBOARDS means a wheeled device designed to transport a rider in a
standing position, which device is not otherwise secured to the rider's feet or
shoes.

(D) SCOOTER: Afoot-operated vehicle consisting of a narrow board mounted
between two wheels, tandem, with an upright steering handle attached to
the front wheel.
(E) OPERATE means to ride on or control the operation of a skateboard, roller
skates blades, or scooter.
(F) OPERATOR means every person who operates or is in actual physical
control of a skateboard, roller skates/blades, or scooter.
8-1p-2: PROHIBITED AREAS: No person shall ride or use a skateboard,
roller skates/blades, or scooter:
(A) On any public sidewalk, street, or any public parking lot situated in the
Central Business District, or

(B) On~private property of another without the express permission to do so by
the owner or occupant of said property, or
(C) In any careless, reckless, or negligent manner so as to endanger or be likely
to endanger the safety of any person or property of any other person, or
(D) On any state highway in the city of Monticello.
8-10-3: OBSERVATION OF RULES OF THE ROAD:
(A) The operator of a skateboard, roller skates/blades, or scooter emerging from
any alley, driveway, ar building upon approaching a sidewalk or the
sidewalk area extending across any alleyway, shall yield the right-of--way to
all pedestrians approaching the sidewalk or sidewalk area and upon
entering the roadway shall yield the right-of way to all vehicles approaching
on the roadway.
(B) No person operating a skateboard, roller skates/blades, or scooter shall
attach the same or the person of the operator to any vehicle upon a
roadway.
(C) Every person operating a skateboard, roller skates/blades, or scooter upon a
roadway shall ride as close as possible to the right-hand curb or edge of the
roadway.

(D) No person shall use a skateboard, roller skates blades, ar scooter upon a
public street, sidewalk, or other roadway after sunset and before sunrise.
8-1Q-4: VIOLATIONS: Any person who violates any provision of this
ordinance shall be guilty of a petty misdemeanor. In addition, any
peace officer who observes any person violate any provisions of this ordinance is
authorized to seize the offender's roller skates/blades, skateboard, or scooter and
to hold same at the Wright County Sheriff's Department or City Police
Department. In the event of such seizure, the offender, if an adult, may secure
the return of the article seized after twenty-Four (24) hours have elapsed since the
seizure. In the case of a minor, the article seized shall be returned only to the
parent or guardian of such minor offender after twenty-four (24) hours have
elapsed since the seizure.
