Koropchak advised that at the Decemher I-lRA meeting the commissioners approved additional assistance in an amount not to exceed $30.000 for parking lot development on the I-Iamond and Fluth/City pareel from TIf District 1-22 Surplus Dollars. The additional up-front TIF assistance \vill he not to exceed $30,000 upon submission of evidence of construction completion and payment . HRA Minutes - 01/02/02 . Fluth and his architect received DAT approval fClI' design, subject to certain quality of exterior material. on Decemher 18 \vith the signage design referred to the Building Official. The project. no longer kno\vn as the Amoco site. is noW "Landmark Square"'. Attorney Greensweig amended the Private Redevelopment Contract. Koropchak <1lhised that she rnet with Kathy Froslie (very interested), Steve Johnson (very interested). Scott Douglas (not interested but willing to make facade improvements to tie in with a new project), Poirer (in Texas. voice-mail \ventto his attorney. l11ailed letter of intent to attorney). Springborg (very interested). did not meet with Heaton (not interested but l11ailedletter of intent). and Kjellberg never returned phone call for appointment (l11ailedletter or intent). Each party was asked to return the letter of intent by January 2. 2002. The intcnt or the lettcrs was to define feasibility and boundary lines for a potential project. Koropchak also stated that Steve Johnson was interested but had not gotten the letter sent off. Johnson adviscd that he would get the \ctter of intent to Koropchak. She noted that she will continue to work on this and it \vas noted that with the intcrested parties and the City lot. it amounted to approx. 3/4 of the block. I-le noted that the City Council reviewed this map several weeks ago and made their recommendation. O'Neill noted that the upper northwest corner is zoned industrial and this is in agreement with the Township and the City. O'Neill noted that the main change in the plan is that the fanner Bohanen property is currently zoned Industrial and the change would be to split it between Industrial/Residential. \\ith the residential lying adjacent to the Silver Springs Golf Coursc. . 7. Brad Bargcr addcd that the recommcndation from the t'v'larkcting Committee \vas to get an industrial sitc plan in placc and move ahead. Koropchak advised that the ""') . IIR^ Minutes - 0 I /02/02 . recommendation outlined in the agenda \vas from the IDC but she did state that the IDC had stated. in their motion that they \vanted "control of a site fClI' industrial development and to commit to construction completion in 2002". O'Neill stated that he did not think that thc intent was to have construction completion by 2002 as this did not seem like a logical time frame. There was discussion on whether the I-lRA should specify the industrial land to be thc Remmc\c parcel or the Gold Nugget parcel. O'Neill advised that the City should kno\v the status of the Gold Nugget parcel in the next few weeks and suggested the HRA hold off on the requcst for re-zoning of the Remmele parcel until that time. It was also noted that the Rcmmcle parcel has utilities in place already. The HRA asked about o\vning and marketing an industrial park and it was stated that they could do this. Dan"in Lahr stated possibly the HRA should advise the City Council and Planning Commission that they would. like to own an industrial park and have a plan in place \vithin the next 18 months. After further discussion the HRA decided that they would like construction to begin in the Spring if2003. with the parcel platted. utilities in place. and o\vncd by the City. . A MOTION WAS MADE BY BRAD BARGER TO RECOMMEND TO THE PLANNINCJ COMMISSION AND THE CITY COUNCIL TO HAVE A COMPLETED INDUSTRIAL PARK OWNED BY THE liRA/CITY WITH LOTS READY TO SELL IN APRIL OF 2003. Koropchak advised that she ran an ad for tvvo weeks in the shopper and Monticello TilT\es for I-IRA commissioners. stating there were five inquiries and that she had encouraged people to fill out applications. There was only one application turned in by today's date. Korpchak asked if the HRA would like her to run an ad again for 2 more weeks due to the ad being previously run during the holidays and a slow response. The HRA concurred. Lahr also advised to post the ad on the bulletin board at the Community Center, in the Chamber ne\vs\ctter and use the Chamber sign on the Corner of Hwy 25/Broad\vay. 9. Reference and backl!round: Back on November 14,2001, the l-IRA approved pay-as-you-go TIF assistance in the amount of $163,000, 18 units at an EMV of $148,410 per unit with the initial deposit of $5,000 for the Mike Cyr housing project. Interest rate to be negotiated. Subject to execution of a Private Redevelopment Contract by February 2002, Front Porch (Mike Cyr) has submitted the $5,000 deposit and will execute the Preliminary Development Agreement January 30,2002. Mark Ruff and Dan Greensweig have been authorized to begin preparation of documents, A couple of changes to the initial TlF casht1ows: Build-out time changed from 6 units pcr each first and second year and 2 units in third year to 6 units per year over three. This may reduce the amount of tax increment; however, the local tax rate is 145.771%. An estimated tax rate of 138% was previously used. Tax increment will be collectcd 15 years from the first date tax increment is received, interest to be 7.25%, and 20% of the tax increment will be retained by the lIRA. The Private Redevelopment Contract would be approved by the IIR^ at their March meeting not February 2002, 95% of the 18 owner-occupied units lYlust be occupied by income qualified hlmilies, Developer must submit evidence for the "but for" test. The developer would like to elose on acquisition of the properties: vacated street, Ruff, and Grubb on Fcbruary 28 and commence construction April 1,2002, This is the normal process to establish a new TIF District and later the HRA will review the TIF Plan and Private Redevc10pment Contract. [Council packet information sent by March I5, 2002J By April 30,2002 Ehlers certifies Plans with county and state. *Because the City staff believes that the proposed tax increment district will not require unplanned county road improvements, the TIF Plan will not be forwarded to the County Board 45 days prior to the public hearing- The County Board, by law, has 45 days to review the plan to determine if any county roads will be impacted by the development Please be aware that the County Board could claim that tax increment should be used for county roads, even after the public hearing. . e ' ~.~~,~,~,~ . . . HRA Agenda - 2/6/02 5. Consideration to hear re uest relative to Tax Increment Deficienc for T. ..1. Martin Inc. A. Reference and background: I received a telephone call from Eric Bondhus relative to the letter dated January 14, 2002. The letter recapped the accumulated tax increment deficiency and the balance due on January 2S, 2002. Because the property taxes for one-half of payabJe year 2001 are delinquent and remain so as of January 29, 2002 ($6,304.74 as of January 31,2002 including penalties per Auditor's Office), the deficiency balance amount is $11,117. If the property taxes had been paid, it is estimated the deficiency balance amount would be $7.413. Given the current income stream and assuming taxes arc current, the estimated deficiency balance on August 1, 200S would be approximately $17,000. Letters were written to T. J. Martin, Inc. on the following dates: August 2, 1999, September 17, 1999, December 2000, January 12, 2001, and January 2002. Per the lctter of January 2002, Mr. Bondhus was told of the BRA meeting of February 6 and requested to be on the agenda. He asked, how the TIF estimates could be so far off? In 1996, the class rate for c/i were 3(Yo for first $IS0,000 and 4.6% over $ISO,OOO and the tax rate was frozen at 11 0.S81 o;(). Since that time, the class rates have continually decreased to a rate in 200 I of l.YYrI for first $ISO,OOO and 2% over $IS0,000, and the tax rate has increased. This is one of the last up-front TIF assistance in the amount of $37,900 for land and site improvement costs. An Assessment Agreement has the estimatcd market value listed at least $240,000 which has not been a problem. The construction completion datc was scheduled for October 1, 1997, per the Contract and the Certificate of Completion was issued December 1, 1997. The up-front TIF assistance was a loan from the HRA General Fund at 8.25% interest rate, accrual date was December 7, 1997. Per the Contract, the lastTIF payment date is August 1, 200S. The BRA elected to decertify the district as early as possible to avoid the LGA/HACA Match or Penalty. Legislators did away with the Match/Penalty effective 2002. The maximum life of the district is 11 years or November 2007. To bc consistent with past tax increment deficiencies, the business was advised annually ofthe dcficiency and within the last year of tax incremcnt due, the HRA approved payments of the tax deficiency in three equal annual payment without interest. Referencc and backl!round: On November 14,2001, the HRA determined a selling price of $300,000 for the northerly one-half of Block 54 based on development cost estimates prepared by staff and the city engineer consultant for a finished pad-site and extended the effective date of the preliminary agreemcnt with Hans Hagen Homcs, Inc. to April 2002. Thc motion included an optional selling price of $225,000 for a non-finishcd pad-site. Mr. Hagen accepted the selling pricc of $300,000 as a finished pad site. At a mceting held among the city engineer and planner consultants, stafe and Mr. Hagen; the dcsign and site plans were discussed. Later the HRA Attorney met with us to gathcr information for thc Redevelopment Contract. A draft copy of the contract was revicwed by Ilagen and myself with amendments suggested. It is anticipated the final draft will be ready for HRA approval on February 6, 2002. The City will be a party to the contract as the Front Street replacement improvements are part of the project. Mr. Ilagen has informed me of a new design f100r plan for thc development which was mailed on January 30. The final draft of the Contract would be presented to the City Council on February 11, 2002. I received a voice-mail from Ken Helvey stating Attorney Peterson inquired about ii1ing for business income loss. Helvey anticipates they will file. Was informed they must have solid documentation. Attached letter requesting Puhlie Works cut down trees. h) Amoco site - I-lave been informed that the Amoco site is contaminated. Bjorklund working with MPCA. lie has hired a firm out of Duluth to prepare a re-mediation plan for the MPCA and to apply [or PETRO Funds. Project delayed. Fluth in Arizona and l3jorklund in Florida. Fluth has not executed amendment to our Contract f<..)r additional $30,000 parking dollars. Restaurant applied for liquor license and was hoping to open August 1. c) Scattered housing project - The City Council approved acquisition of the Havel parcel at $50,000. At this time, two of the five parcels are purchased. Sheri, CMIF, made offers to the remaining three, they did not accept. Sheri will proceed to make counter-offers after a meeting with local corporate officials requesting a contribution to fill the financial gap and/or to enhance quality of the product. We are anticipating acquisition costs to exceed the initial budget of $300,000. We expect an answer from the corporation within two weeks. It is still the intent to construct all 10-11 units this summer. d) Copy of TIF semi-annual payments. e) Fay-Mar building - Ron Musich started a new husiness, RSM Industries, Inc.. which is located in his vacated building along Chelsea. Dear John: With the redevelopment of the four northerly parcels of Block 54 (known as "the site") located along Front Street and the Prelirninary Development Contract between Hans Hagen Homes, Inc. and the HRA, the I--IRA has agreed to prepare "the site" as a finished-pad site prior to conveying "the site" to Mr. Hagen. Mr. Hagen plans to develop "the site" as a PUD for construction of 10 row homes. The HRA is working with City Engineer Consultant Bret Weiss, WSB, Inc., to prepare "the site" as a finished-pad site. In a meeting between city staff and Mr. Weiss, it was suggested that the Public Works Department cut-down the trees located within "the site" and remove the cut-down debris. The tree stumps and roots are to remain and will be removed at a later date. It is important that the trees located along the southerly perimeter of "the site" not be cut-down at this time, as no survey has been cornpleted to define the boundary line between "the site" and the Wunn eight-plex and Warner parcels.
