City Council Minutes 12-29-2009 SpecialMINUTES SPECIAL MEETING — MONTICELLO CITY COUNCIL Monday, December 29, 2009 — 6:30 a.m. Present: Clint Herbst, Tom Perrault, Glen Posusta, Brian Stumpf, Susie Wojehouski Absent: None 1. Call to Order Mayor Herbst called the special meeting to order at 6:30 a.m. 2. Consideration of approving Pole Attachment License Agreement with Xcel Energy Jeff O'Neill explained how the agreement would work and the cost per pole, of which there is potential to use up to 429 poles in the core city and along County Road 39 East. He noted that, as the opportunity arises, the fiber cables could be removed from the poles and placed in the ground. Brian Stumpf asked if there is the possibility of having significant additional costs for burying the cable at a later date when it is not convenient or done in conjunction with another project. Jeff O'Neill said that Xcel does not intend to quit using their poles for electric transmission so it is not probable that the City would have to move their cables unless they choose to do so. Clint Herbst asked when service would be available to residents and businesses in this area. Don Patten noted they are hoping to be able to provide some service as they get the lines in place but cannot predict any dates at this time. Brian Stumpf asked if there are any greater hazards with having the lines on poles instead of in the ground. Don Patten noted that there is more chance of catching the overhead wires with some kind of equipment. However, the service is being set up on a redundant basis which should eliminate the possibility of completely losing service due to a problem like this. Don also noted that the wires are very strong and can withstand most conditions, such as severe weather. GLEN POSUSTA MOVED TO ACCEPT ALTERNATIVE #1 TO APPROVE THE POLE LICENSE AGREEMENT WITH XCEL ENERGY. Jeff O'Neill explained that the insurance costs will be borne by MP Nexlevel, contractor for the project, and their insurance exceeds that required by Xcel. Tom Perrault also asked about the 60 day time frame allowance if Xcel were to terminate the agreement. Don Patten explained that is common language in a pole license agreement. There is a provision for Xcel to provide adequate time for removing cables if weather prohibits burying in the ground. In actuality, there is no known record of Xcel cancelling a pole license agreement. Special Council Minutes— December 29, 2009 Page 1 3. Approval of bills for end of 2009 Council members inquired on various bills listed in the bill register, including purchase of a pallet jack and comparative pricing in use of consultants. BRIAN STUMPF MOVED TO APPROVE PAYMENT OF THE BILLS FOR THE END OF 2009. SUSIE WOJCHOUSKI SECONDED THE MOTION. MOTION CARRIED 5 -0 TO PAY THE BILL REGISTER TOTALING $1,325,327.75. 4.
