Planning Commission Minutes 10-27-2014 (Special Meeting)MINUTES SPECIAL MEETING — MONTICELLO PLANNING COMMISSION Monday, October 27th, 2014 - Mississippi Room, Monticello Community Center Present: Brad Fyle, Sam Burvee, Charlotte Gabler Absent: Alan Heidemann Others: Angela Schumann, Steve Grittman - NAC, Ron Hackem-nueller, Lloyd Hilgart, Steve Johnson, Mercedes Turner 1. Call to order Brad Fyle called the meeting to order at 5:00 p.m. 2. Public Hearing- Consideration of a request for amendment to the Monticello Zoning Ordinance, Chapter 5, Section 1, Use Table, redesignating "Personal Services" as Permitted Use in the L -2 Sub- District of the CCD. Applicant: Citv of Monticello Planning Case Number: 2014 -050 Steve Grittman indicated that staff had recently been approached by a business owner proposing to locate a yoga studio in a building in the northwest quadrant of Highway 25 and CSAH 75. Grittman explained that the zoning ordinance defines such uses as Personal Services and that such uses are only allowed on upper floors in the L -2 Sub- district of the Central Community District (CCD) by Conditional Use Permit (CUP). Angela Schumann pointed out that there are a number of Personal Services establishments already in place in the L -2 which are defined as existing lawful nonconforming. She indicated that amending the ordinance would enable these businesses to become conforming permitted uses as well. Grittman provided some clarification related to the intent of the ordinance in response to commissioner questions. He stated that ordinance discussions had focused accommodating river - oriented shopping, including tourism, entertainment and recreational uses which might occupy existing development or future multi -story buildings at this corner. He noted that Personal Services uses fit within the objectives for the district and support the intent of the Embracing Downtown Monticello chapter of the Comprehensive Plan. Brad Fyle opened the public hearing. Steve Johnson, who owns parcels on Block 52 in the L -2 Sub - district, stated that he fully supports the proposed amendment. He recommended that any type of traffic or development in the downtown should not be discouraged at least in the short term. Mercedes Turner stated that she and her business partner had done a lot of research related to establishing a personalized yoga studio and coaching service in the downtown. She pointed out that Monticello residents currently drive to other cities for this service and suggested that allowing this use would keep local dollars in town and encourage tourism. As there were no further comments, the public hearing was closed. CHARLOTTE GABLER MOVED TO ADOPT RESOLUTION NO. 2014 — 107 RECOMMENDING APPROVAL OF ORDINANCE NO. 603, AMENDING THE ZONING ORDINANCE TO CHANGE TABLE 5 -1A BY REDESIGNATING PERSONAL SERVICES AS A PERMITTED USE IN THE CCD L -2 SUB- DISTRICT. SAM BURVEE SECONDED THE MOTION. MOTION CARRIED 3 -0. Angela Schumann noted that this item would be considered by the City Council as part of its regular agenda later in the evening. Schumann also mentioned that staff had received one application for the vacant Planning Commission position. She suggested that the Planning Commission schedule an interview date as part of the November 5th meeting agenda. 3. Adjournment CHARLOTTE GABLER MOVED TO ADJOURN THE MEETING AT 5:16 PM.
