Planning Commission Minutes 11-05-2014MINUTES REGULAR MEETING — MONTICELLO PLANNING COMMISSION Wednesday, November 5th, 2014 - Mississippi Room, Monticello Community Center Present: Brad Fyle, Sam Burvee, Charlotte Gabler Absent: Alan Heidemann Others: Steve Grittman (NAC), Ron Hackenmueller, Lloyd Hilgart, Don Jensen (Paxmar) 1. Call to order Brad Fyle called the meeting to order at 6:00 pan. 2. Citizen Comments None 3. Consideration to approve Planning Commission minutes CHARLOTTE GABLER MOVED TO APPROVE THE OCTOBER 7TH, 2014 REGULAR MEETING MINUTES. SAM BURVEE SECONDED THE MOTION. MOTION CARRIED 3 -0. 5. Public Hearing - Consideration of a request for Amendment to Development Stage Planned Unit Development (PUD). Applicant: Sunset Ponds, LLC /Jensen, Donald (NAC) Planning Case Number: 2014 - 048 Steve Grittman summarized that applicant Don Jensen asked to amend the existing Planned Unit Development (PUD) in Sunset Ponds 2nd Addition to allow the same standards on Lots 6, 7, 9 and 10, Block 3 as had been granted the rest of the subdivision when the PUD was amended in 2012. The previous amendment had allowed for additional flexibility in home design and construction due to modifications to the 20% front building materials requirement, garage door width, 5' garage forward regulation, and overall garage size relative to home footprint. Charlotte Gabler asked about the amount of side setback on the lots. Grittman indicated that the required setbacks were appropriate. Gabler also asked if the commission had discussed staggering the houses to break up the uniform front facade. Grittman said that the commission had recommended only that the facades meet zoning setbacks and that architectural treatments differ. Brad Fyle opened the public hearing. Applicant Don Jensen, representing Paxmar and Sunset Ponds, LLC, stated that Paxmar had decided to exclude the lots from the 2012 PUD amendment to allow the market to determine if the original PUD criteria would be desirable for the four fan - shaped lots. Jensen pointed out that there had been recent interest in developing a larger, two -story house on one of the lots under existing PUD criteria. He said that it made sense however, in terms of uniformity, to move forward with amending the PUD for all four lots at this time. Jensen confirmed that the amendment would allow for larger, front- facing garages with a smaller driveway pattern. Charlotte Gabler asked if there was a way to further spruce up the front of the homes. Jensen indicated that the homeowners would determine vestibule treatments. As there were no further comments, the public hearing was closed. Gabler asked Ron Hackenmueller about the code provisions related to the living space above the garage. Hackenmueller stated that the bonus room would be treated as finished square footage. BRAD FYLE MOVED TO ADOPT RESOLUTION 2014 -111, RECOMMENDING APPROVAL OF AN AMENDMENT TO CONDITIONAL USE PERMIT FOR PLANNED UNIT DEVELOPMENT AS RELATED TO RESIDENTIAL DESIGN STANDARDS FOR T -N (SINGLE- FAMILY) DISTRICT FOR LOTS 6, 7, 9 AND 10 BLOCK 3, SUNSET PONDS 2ND ADDITION, SUBJECT TO THE CONDITIONS OUTLINED IN EXHIBIT Z AND BASED ON A FINDING THAT THE PROPOSED AMENDMENT CONTINUES TO ACHIEVE THE GOALS OF THE ORIGINAL PUD AND IS CONSISTENT WITH THE LONG -RANGE GOALS FOR RESIDENTIAL DEVELOPMENT AS OUTLINED IN THE COMPREHENSIVE PLAN. SAM BURVEE SECONDED THE MOTION. MOTION CARRIED 3 -0. Exhibit Z Sunset Ponds 2nd Addition Amendment to PUD (Lots 6, 7, 9 and 10, Block 3) October, 2014 1. The plans for the building permit shall comply with the Zoning Ordinance minimurn finished square footage standards. 2. The plans for the building permit shall comply with the Zoning Ordinance minimum setback requirements. 3. Stone or brick veneer shall be on both the garage face area and portico as shown on the provided plans dated October 6, 2012. 4. Shake veneer shall not be permitted as an exclusive treatment in lieu of stone or brick veneer, and shall only be used to compliment the brick or stone in meeting the required 20 percent as shown on the plans. 0) 5. Any corner lot shall include additional stone or brick on the secondary right - of -way elevation to better meet the intent of the 20 percent "front building fagade" requirement. 6. All garage doors shall include raised panels and may include window lights. 7. No homes on abutting properties may be constructed of the exact same exterior home design. 8. The applicant enter into an agreement for amendment to Planned Unit Development for Sunset Ponds 2nd Addition. 6. Consideration to call for a Public Hearing on December 2"d, 2014 for Amendments to Title 10 of Monticello City Code - Zoning Ordinance and Title 11 of Monticello City Code — Subdivision Ordinance, chapters and sections as follows: a. Monticello Zoning Ordinance, Chapter 2, Section 4(M) — Grading, Drainage and Erosion Control Permit b. Monticello Zoning Ordinance, Chapter 4, Section 10 — Grading, Drainage and Erosion Control c. Monticello Subdivision Ordinance, Chapter 5 — Design Standards Steve Grittman noted that WSB & Associates had reviewed local ordinances for compliance with federal and state requirements mandated for the Municipal Separate Storm Sewer System (MS4) General Permit and recommended a number of amendments to the city's zoning and subdivision ordinances. Grittman asked that the Planning Conunission call for a public hearing to consider the proposed amendments. Brad Fyle said that he didn't want to see any more rules than were necessary and asked if the city had the option not to permit. Grittman indicated that the state would take over local stormwater regulation if the city did not have an approved program. Gabler asked if the program would include educating homeowners about stormwater runoff. Grittman suggested that WSB might address the extent to which public outreach would be a focus in the stormwater program. SAM BURVEE MOVED TO CALL FOR A PUBLIC HEARING FOR DECEMBER 2ND, 2014 FOR AMENDMENTS TO TITLE 10 OF MONTICELLO CITY CODE — ZONING ORDINANCE AND TITLE 11 OF MONTICELLO CITY CODE — SUBDIVISION ORDINANCE, CHAPTERS AND SECTIONS AS FOLLOWS: a. Monticello Zoning Ordinance, Chapter 2, Section 4(M) — Grading, Drainage and Erosion Control Permit b. Monticello Zoning Ordinance, Chapter 4, Section 10 — Grading, Drainage and Erosion Control c. Monticello Subdivision Ordinance, Chapter 5 — Design Standards 3 CHARLOTTE GABLER SECONDED THE MOTION. MOTION CARRIED 3 -0. 7. Added Item • Cancel Previous Call for December 2nd Public Hearing (Grittman) Steve Grittman asked that the Planning Commission cancel a call for a public hearing scheduled for December 2nd to consider a series of minor amendments to the land use component of the Comprehensive Plan (Comp Plan). This action would allow staff time to review and amend the zoning ordinance as it relates to notification requirements for Comp Plan amendments. Although state statute requires only published public hearing notice for Comp Plan amendments, Monticello's ordinance requires mailed notice for even the most inconsequential amendments. Grittman indicated that staff had discussed revising the ordinance to track with state notification requirements when making minor changes and identifying a threshold at which mailed notice would be required for more substantive amendments. CHARLOTTE GABLER MOVED TO CANCEL THE CALL FOR PUBLIC HEARING RELATED TO COMP PLAN AMENDMENTS SCHEDULED FOR THE DECEMBER 2ND, 2014 PLANNING COMMISSION MEETING UNTIL COMP PLAN AMENDMENT NOTIFICATION REQUIREMENTS HAVE BEEN AMENDED IN THE MONTICELLO ZONING ORDINANCE. Consideration to set interview schedule for Planning Commission vacancy Staff received one application for the open seat on the Planning Commission since it was posted on October 8t'. The commissioners discussed scheduling an interview with the applicant for 5:15 p.m. prior to their next regular meeting and agreed to continue to post the position to provide an opportunity for additional applications.
