RESOLUTION NO. 2015-023
APPROVING VACATION OF DRAINAGE AND UTILITY EASEMENTS OVER AND
ACROSS LOT 5, BLOCK 4; LOTS 24 & 51, BLOCK 5; LOT 9, BLOCK 6; AND LOT 9,
BLOCK 7 OF SUNSET PONDS 2ND ADDITION
WHEREAS, a petition was received on March 3, 2015, requesting vacation of drainage and
utility easements for Sunset Ponds 2nd Addition as shown in "Attachment A "; and
WHEREAS, the Monticello City Council, pursuant to Minnesota Statute 412.851 and 462.358,
desires to consider the following:
Vacate the drainage and utility easements dedicated on the plat of SUNSET PONDS
SECOND ADDITION, Wright County. Minnesota, described as follows:
Drainage and utility easement over all of Lot 5, Block 4; and
Drainage and utility easement over all of Lot 24, Block 5; and
Drainage and utility easement over all of Lot 51, Block 5; and
Drainage and utility easement over all of Lot 9, Block 6; and
Drainage and utility easement over all of Lot 9, Block 7.
WHEREAS, on March 16th, 2015, the City published and posted notice of a Public Hearing to
be held on April 13th, 2015, to consider said vacations as petitioned; and
WHEREAS, on March 171h, 2015, affected property owners were mailed a notice of the Public
Hearing to be held March 24, 2014; and
NOW THEREFORE, BE IT RESOLVED: that the following described drainage and utility
easements be vacated:
Drainage and utility easement over all of Lot 5, Block 4; and
Drainage and utility easement over all of Lot 24, Block 5; and
Drainage and utility easement over all of Lot 51, Block 5; and
Drainage and utility easement over all of Lot 9, Block 6; and
Drainage and utility easement over all of Lot 9, Block 7.
BE IT FURTHER RESOLVED: that granting of said vacation is subject to the following
conditions:
• Approval of the Sunset Ponds Third Addition final plat by the City Council of the City of
Monticello.
• The final plat of record shall include the Wright County Recorder's document numbers
for the vacation easements described herein.
BE IT FURTHER RESOLVED, that the Mayor and City Administrator are hereby authorized to
sign all documents necessary to effectuate the intent of this resolution; and
BE IT FURTHER RESOLVED, that the City Clerk shall prepare a notice of completion of the
proceedings and record said vacations with the County.Recorder and County Auditor.
NOW THEREFORE, BE IT HEREBYRESOLVED BY THE CITY COUNCIL OF
MONTICELLO, MINNESOTA:
ADOPTED BY the City Council of Monticello, Minnesota this 131' day of April, 2015.
