RESOLUTION NO. 2015-023A
APPROVING VACATION OF DRAINAGE AND UTILITY EASEMENTS OVER AND
ACROSS LOT 5, BLOCK 4; LOTS 24 & 51, BLOCK 5; LOT 9, BLOCK 6; AND LOT 9,
BLOCK 7 OF SUNSET PONDS SECOND ADDITION
WHEREAS, a petition was received on March 3, 2015, requesting vacation of drainage and
utility easements for Sunset Ponds Second Addition as shown in "Attachment A "; and
WHEREAS, the Monticello City Council, pursuant to Minnesota Statute 412.851 and 462.358,
desires to consider the following:
Vacate the drainage and utility easements dedicated on the plat of SUNSET PONDS
SECOND ADDITION, Wright County. Minnesota, described as follows:
Drainage and utility easement over all of Lot 5, Block 4; and
Drainage and utility easement over all of Lot 24, Block 5; and
Drainage and utility easement over all of Lot 51, Block 5; and
Drainage and utility easement over all of Lot 9, Block 6; and
Drainage and utility easement over all of Lot 9, Block 7.
WHEREAS, on March 16th, 2015 , the City published and posted notice of a Public Hearing to
be held on April 13th, 2015, to consider said vacations as petitioned; and
WHEREAS, on March 17th, 2015, affected property owners were mailed a notice of the Public
Hearing to be held March 24, 2014; and
NOW THEREFORE, BE IT RESOLVED: that the following described drainage and utility
easements be vacated:
Drainage and utility easement over all of Lot 5, Block 4; and
Drainage and utility easement over all of Lot 24, Block 5; and
Drainage and utility easement over all of Lot 51, Block 5; and
Drainage and utility easement over all of Lot 9, Block 6; and
Drainage and utility easement over all of Lot 9, Block 7.
BE IT FURTHER RESOLVED: that granting of said vacation is subject to the following
conditions:
• Approval of the Sunset Ponds Third Addition final plat by the City Council of the City of
Monticello.
• A Certificate of Approval for Vacation of Drainage and Utility Easements be recorded at
the Wright County Recorder's Office.
BE IT FURTHER RESOLVED, that the Mayor and City Administrator are hereby authorized to
sign all documents necessary to effectuate the intent of this resolution; and
BE IT FURTHER RESOLVED, that the City Clerk shall prepare a notice of completion of the
proceedings and record said vacations with the County Recorder and County Auditor.

Re: final plat application and Vacation of existing easements Sunset Ponds 3'd Addition lands
Ms. Schuman:
Please accept this narrative and the City forms as a complete application for final plat variance. We
hereby petition Monticello to vacate its current Interest over lot S, Block 4; Lot 24, Block 5; Lot 51, Block
5; Lot 9, block 6 and Lot 9, Block 7 consistent with exhibits prepared by the Surveyor, Meyer- Rohiin Land
Services.
New easements over public infrastructure existing and added with the submitted final plat will replace
In kind and in confined locations the same drainage and utility easements. The main change is a shift
from blanket easements to standard corridor easements. New storm sewer pipes extend the drainage
efficiency with the new plat.
The plans submitted are as approved by the City Council on February 23"; 2015 with the only change
being form Lots 1 through 10, of the re- platted lots west of Golden Pond Lane. The change is to comply
with the condition of approval to improve Lot 6 shape and orientation.
The legal homeowner association documents will continue for recording, pending any comments
received from the City attorney to our counsel at L ®SG.

for the easement vacation and for the final plat for new recordings. We Understand this ,nay take two
Council actions In order to have the cleared title for County Surveyor review.
