City Council Resolution 2015-34CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION NO. 2015-034 A RESOLUTION OF THE MONTICELLO CITY COUNCIL APPROVING A CONDITIONAL USE PERMIT FOR MAJOR UTILITY ALLOWING AN ELECTRICAL SUBSTATION DEVELOPMENT ON THE FOLLOWING PARCEL: LOT 1, BLOCK 1, FIRST LAKE SUBSTATION ADDITION WHEREAS, Xcel Energy has submitted an application foa approval of a Conditional Use Permit for a parcel of land to utilize the property for electrical substation purposes; and WHEREAS, the property in question is guided for industrial uses under the "Places to Work" category in the Monticello Comprehensive Plan; and WHEREAS, the property in question will be zoned 1 -1, Light Industrial upon the adoption and publication of the requisite rezoning ordinance; and WHEREAS, the proposed project is consistent with the requirements of the zoning ordinance for the intended use; and WHEREAS, the Planning Commission granted variances allowing a 60 foot setback from the south property line and modified driveway paving requirements to accommodate the plan and the Conditional Use Permit; and WHEREAS, the proposed project will meet the goals and policies of the Monticello Comprehensive Plan; and WHEREAS, the Planning Commission held a public hearing on April 7, 2015 on the application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the City Council has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the City Council of the City of Monticello hereby makes the following Findings of Fact in relation to the recommendation of approval: 1. The property is guided for industrial uses, consistent with the proposed use and zoning. 2. The use meets the performance requirements for Utility installations as identified, or as modified, by the Planning Commission's findings and approval of variances. 3. The use will not overburden the City's street or utility services. 4. The use will not create undue levels of traffic or other negative impacts. 5. The Development Agreement identifies and addresses the applicable conditions required to develop the plat in accordance with the City's regulations. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello, Minnesota: The Monticello City Council hereby approves the Conditional Use Permit for Major Utility as recommended by the Planning Commission for an electrical substation on the property in question, subject to the conditions identified in Exhibit Z of the applicable staff report, and as identified below: 1. Additional landscape screening along the west boundary to screen the substation enclosure area from the Bertram Park property. 2. Pavement of the required driveway from the connection between Dalton and the entrance to the facility, with the addition of a gate marking the entrance approximately 100 feet west of Dalton Avenue. 3. Compliance with the conditions identified in the City Engineer's comment letter dated March 27; 2015; and other requirements as identified by staff. 4. Execution of the Development Agreement and compliance with all terms and conditions. ADOPTED this 27th day of April, 2015, by the City Council of the City of Monticello, Minnesota.
