RESOLUTION NO. 2015-040
ACCEPTING IMPROVEMENTS AND APPROVING FINAL PAYMENT ON
2014 STREET LIGHTING IMPROVEMENTS
(WEST 7TH STREET BETWEEN ELM STREET AND CR 39)

WHEREAS, pursuant to a written contract which the City of Monticello awarded to WH
Services of Rockford, Minnesota, the contractor has satisfactorily completed the work for the
West 7t' Street lighting improvements and appurtenant work in accordance with the contract;
NOW THEREFORE, RE IT RESOLVED BY THE CITY Off' MONTICELLO, MINNESOTA,
the work completed under said contract is hereby accepted and approved and that the Mayor and
City Administrator are hereby directed to issue a proper order for the final payment on such
contract subject to receipt of the following:
1) Satisfactory showing that the contractor has complied with the provisions of Minnesota
Statutes 290.92 requiring withholding state income tax (IC134 forms);
2) Evidence in the form of an affidavit that all claims against the contractor by reasons of the
contract have been fully paid or satisfactorily secured (lien waivers);
3) Consent of Surety to Final Payment certification from the contractor's surety; and
4) Two -year maintenance bond to start and extend two years from the date of acceptance of the
project by the City Council.
BE IT FURTHER RESOLVED, the City of Monticello shall enter into a 5 -year maintenance
contract with WH Services, which shall start one year after acceptance of the project. The City
can opt out of the contract with one year's written notification to WH Services.
