RESOLUTION NO. 2009-60
CALL FOR PUBLIC HEARING ON VACATING
DRAINAGE AND UTILITY ACCESS EASEMENTS FOR PORTIONS
OF LOT 1, 2 AND 3, BLOCK 4, RIVER FOREST 2ND ADDITION
WHEREAS, the Monticello City Council, pursuant to Minnesota Statute 412.851 and 462.358, desires
to consider the vacation of drainage, utility and access easements over and across the following
property legally described as follows:
Parcel #1:
A utility /access easement over, under, and through Lot 1, Block 4 of RIVER FOREST 2ND,
Wright County, Minnesota, described as follows:
The east 20.00 feet of the west 30.00 of Lot 1, Block 4, River Forest 2ND Addition, according to
the recorded plat thereof, Wright County, Minnesota; except the northerly 6.00 feet and the
southerly 12.00 feet of said Lot 1.
Parcel #2•
A utility /access easement over, under, and through Lot 2, Block 4 of RIVER FOREST 2ND,
Wright County, Minnesota, described as follows:
The east 20.00 feet of the west 30.00 of Lot 2, Block 4, River Forest 2ND Addition, according to
the recorded plat thereof, Wright County, Minnesota, and also that part of said Lot 2 lying
easterly of the westerly 30.00 feet thereof, and lying westerly of a line drawn parallel with and
distant 40.00 feet easterly of the westerly line of Lot 3, said Block 4, and its southerly
extension; except the northerly 6.00 feet and the southerly 6.00 feet of said Lot 2.
Parcel #3:
A utility /access easement over, under, and through Lot 3, Block 4 of RIVER FOREST 2ND,
Wright County, Minnesota, described as follows:
The easterly 30.00 feet of the westerly 40.00 feet of Lot 3, Block 4, River Forest 2ND Addition,
according to the recorded plat thereof, Wright County, Minnesota; except the northerly 6.00
feet and the southerly 6.00 feet of said Lot 3.
NOW THEREFORE, BE IT HEREBY RESOL VED BY THE CITY COUNCIL OF
MONTICELLO, MINNESOTA:
1. The Council will consider the vacation of such easements and a public hearing shall be held
on such proposed vacation on the 9a' day of November, 2009, before the City Council in the
Council Chambers located at the Monticello Community Center at 7 p.m.
2. The City Clerk is hereby directed to give published, posted and mailed notice of such
hearing as required by law.
