City Council Minutes 06-11-2012MINUTES REGULAR MEETING — MONTICELLO CITY COUNCIL Monday, June 11, 2012 — 7 p.m. Mississippi Room, Monticello Community Center Present: Clint Herbst, Lloyd Hilgart, Tom Perrault, Glen Posusta, Brian Stumpf Absent: None 1. Call to Order and Pledge of Allegiance Mayor Herbst called the meeting to order at 7:00 p.m. and declared a quorum present. The Pledge of Allegiance was recited. 2A. Approval of Minutes — May 29, 2012 Regular Meeting GLEN POSUSTA MOVED TO ACCEPT THE MAY 29, 2012 REGULAR MEETING MINUTES AS CORRECTED. BRIAN STUMPF SECONDED THE MOTION. MOTION CARRIED 5 -0. 3. Consideration of adding items to the agenda • Crosswalk at 6d' & Maple (Clint Herbst) • Stop sign study update (Clint Herbst) 4. Citizen comments, public service announcements, and staff updates a. Citizen Comments: none b. Public Service Announcements: 1) CenterPoint Energy — presentation of donation check for Fire Department: Sherry Kemmetmueller from CenterPoint Energy spoke on the Community Partnership grant they are giving to the Fire Department to help purchase safety equipment. The grant for $1050 is for two Pro /pak portable foam systems. Steve Joerg accepted the check and commented that this is about the 3rd grant received in the last 5 or 6 years and is very much appreciated. They have a good partnership with CenterPoint in helping with emergency situations. 2) Movie in the Park (6/30) — Angela Schumann invited community residents to attend 66Mouse Hunt" movie on June 30th at Pioneer Park about 9 p.m. Concessions will be available for purchase. Bring your own lawn chairs and blankets. 3) Mississippi River and Bertram Long Lake Canoe /Kayak events — Angela Schumann reported on a new activity being offered this summer through the MCC with excursions on several different dates. Mississippi River City Council Minutes —June 11, 2012 Page 1 canoing and kayaking will take place on Sundays, June 17, July 29 and August 19. Departure times are 2 and 2:30 p.m. with the cost at $30 per person for a canoe and $40 per person for a kayak. Canoe and kayak excursions at Long Lake in Bertram Chain of Lakes Park are scheduled for Thursday, June 21 (6 to 7:30 p.m.), Thursday, July 26 (6 to 7:30 p.m.) and Sunday, August 5 (2 to 3:30 p.m.). Cost is $20 a person for a canoe and $30 a person for a kayak. Children under 12 are free with 2 paid adults. Contact the MCC for more information and to register in advance. 4) Voting for America's Favorite Park — Angela Schumann encourages area residents to vote for Bertram Chain of Lakes as their favorite park. This is offered nationwide as an opportunity to receive funds that would go toward the park. The link for voting can be found on the City's website on the home page scroller and the City's facebook page. 5) Riverfest Duck Adoptions — Clint Herbst reported that duck adoptions will soon be starting and to consider adopting a duck to help raise funds in support of Riverfest. C. Staff Updates: None 5. Consent Agenda: A. Consideration of approving payment of bills for June 11th. THIS ITEM WAS REMOVED FROM THE CONSENT AGENDA. B. Consideration of approving new hires and departures for City departments. Recommendation: Ratify the new hires and terminations for MCC. C. Consideration of approving an application for a temporary charitable gambling permit for Bingo to be conducted by the Monticello Women of Today in conjunction with Art in the Park. Recommendation: Approve the application for a temporary charitable gambling bingo permit for the Monticello Women of Today in conjunction with Art in the Park on July 14, 2012. D. Consideration of approving an application for temporary on -sale liquor license for the Monticello Lions Club for Brewfest, a beer tasting event on August 18, 2012. Recommendation: Approve the application for a 1 -day temporary on -sale liquor license for the Monticello Lions Club for a beer tasting event on August 18, 2012. E. Consideration of a adopting Resolution #2012 -055 establishing an Absentee Ballot Board for the 2012 Elections. Consideration of approving extension of an existing Interim Use Permit for Lot 1, Block 2, Oakwood Industrial Park (1248 Edmonson Av); PID: 155- 018- 002013. Consideration of adopting Resolution #2012 -056 approving a Simple Subdivision and Administrative Lot Combination, and approving a Conditional Use Permit for a detached accessory structure in an R -2 (Single & Two - Family Residential) District; Lots 1 & part of 2, Block 38, Lower Monticello (630 E 4 t Street); PIDs: 155- 015- 038080 and 155- 015- 038010. Applicant: Michaelis, Jeff. Recommendation: Adopt Resolution #2012 -056 approving a simple subdivision and administrative lot combination for Lots 1, 2 and 3, Block 38, Lower Monticello, subject to conditions as follows; also approve a Conditional Use Permit for a detached accessory structure in an R -2 (Single & Two - Family Residential) District at 630 East 4t' Street, subject to conditions as follows. Simple Subdivision/Lot Combination - Conditions ofApproval • The City Engineer shall provide comment and recommendation regarding grading, drainage and related easement issues. The applicant shall provide a Certificate of Survey within 100 days of City Council approval. (completed) Conditional Use Permit - Conditions ofApproval • The City approve the requested Simple Subdivision as graphically depicted upon the certificate of survey dated May 14, 2012. • A building permit for the accessory structure shall not be issued until such time as the certificate of survey has been recorded. • Accessory building space (attached and detached) shall be utilized solely for the storage of residential personal property of the occupant of the principal dwelling. • No accessory building space shall be utilized for commercial purposes. • The submitted accessory building elevations shall be modified to specify the direction of the structure's overhead door upon the subject site. • Exterior finish materials and color of the detached accessory building shall match the site's principal structure. • Only one driveway is permitted for the single family parcel, in accordance with the Zoning Ordinance regulations for residential property. Consideration of adopting an Agreement between the City of Monticello and Gigabit Squared to provide professional services for consulting to the City on management and operations of FiberNet Monticello. THIS ITEM WAS REMOVED FROM THE CONSENT AGENDA. BRIAN STUMPF MOVED TO APPROVE THE CONSENT AGENDA WITH THE REMOVAL OF ITEMS A, F AND H. GLEN POSUSTA SECONDED THE MOTION. MOTION CARRIED 5 -0. 6. Consideration of items removed from the consent agenda for discussion 5A. Consideration of approving payment of bills for June 11th Tom Perrault had a question on a TDS billing for phone directory services. Ben Ranft explained it is for entries in the Monticello phone directory for FiberNet customer accounts. Glen Posusta had a question on a liquor store invoice paid for Jack Morris. This will be referred to Tom Kelly for follow -up. GLEN POSUSTA MOVED TO APPROVE PAYMENT OF THE BILL AND PURCHASE REGISTERS FOR JUNE 11TH IN THE AMOUNT OF $470,223.51. TOM PERRAULT SECONDED THE MOTION. MOTION CARRIED 5 -0. 5I: Consideration of approving extension of an existing Interim Use Permit for Lot], Block 2, Oakwood Industrial Park (1248 Edmonson Av); PID: 155- 018 - 002013. Applicant. Monticello Independent School District/Alternative Learning Program (ALP) Glen Posusta is not convinced that the City should continue to provide the interim use after this extension. Jim Johnson, Monticello School Superintendent, explained that they prefer to find locations outside of the regular setting for the Alternative School students. Mr. Johnson said that the financial arrangements are very beneficial for the school district with the lease that they have. Clint Herbst suggested that perhaps the owner, Ron Chihos, would consider requesting a rezoning of the property. Ron Chihos asked what zoning might be considered. Angela Schumann explained that under the Comprehensive Plan the property is guided commercial so any classification B -1 through B -4 would be satisfactory. However, use as a school would not be permitted in a Commercial zone, while use as a school is allowed in an Industrial zone, which is the current zoning. Clint Herbst stated that he does not have an issue with the school leasing this property. Lloyd Hilgart also indicated he is fine with the lease as long as both parties have a satisfactory agreement in place. Glen Posusta noted that he has observed a few issues with the students on the premises related to parking and smoking. Jim Johnson indicated he will work with the School Resource Officer to look into those things. City Council Minutes —June 11, 2012 Page 4 BRIAN STUMPF MOVED TO EXTEND THE INTERIM USE PERMIT FOR THE ALTERNATIVE LEARNING PROGRAM BASED ON A FINDING THAT THE USE CONTINUES TO RAISE NO ISSUES WITH SURROUNDING USERS AND IS IN COMPLIANCE WITH SITE ZONING REQUIREMENTS, SUBJECT TO THE FOLLOWING CONDITIONS. LLOYD HILGART SECONDED THE MOTION. MOTION CARRIED 5 -0. • A short -term termination date of three years is established to ensure that the City's development objectives are not affected by the location of the school facility. • The building shall be remodeled only to the extent that convenient re -use would still be possible. • The parking shall be evaluated annually during the term of the interim use permit to determine adequacy for the interim school use of the property. Any required expansion of the parking area to meet parking needs will require curbed perimeter. 5H. Consideration of adopting an Agreement between the City of Monticello and Gigabit Squared to provide professional services for consulting to the City on management and operations of FiberNet Monticello Tom Perrault was hoping to hear from a representative of Gigabit Squared and asked Jeff O'Neill to talk about the proposed proposal. Jeff O'Neill first complimented HBC on their work managing the system and noted that they are ending their management contract effective in about 90 days. Jeff O'Neill noted that the City has been engaged in some discussions with Gigabit Squared and is interested in having them provide consulting services for the City. Jeff O'Neill noted that FiberNet is dealing with some financial issues and the City will be engaging the services of an independent third party firm, Meiserow Financial, to evaluate the system and review the agreement with Gigabit Squared. This is in keeping in the terms of the FiberNet Revenue Bond. Jeff O'Neill introduced Mark Pultusker of Gigabit Squared. Mark Pultusker talked about the company, which was tasked with working with both public and private entities in the area of broadband technology, particular fiber optics. He talked briefly about the power that universities have harnessed in utilizing fiber optics. Gigabit Squared is partnering with a consortium of universities, called GigU, to provide fiber optics services and a university in turn provides student resources. One facet that Gigabit Squared deals with is provision of cable, internet and phone (triple -play) services. GigU will be involved with implementing and providing these services to entities such as nursing homes. They will also be developing new applications to run on fiber optics. Mark Pultusker discussed some of the people that work within Gigabit Squared and the diversity of backgrounds and experience that they bring to the company. Mark Pultusker indicated that they became involved with Monticello in looking at opportunities for partnerships for use of the city's fiber network. They are prepared to study the issues that FiberNet is facing and work on scenarios to increase the subscriber base and revenues. They would also consider investing in the system to help bring in subscribers and business partners, which would be more than simply managing the operations of the system. City Council Minutes —June 11, 2012 Page 5 LLOYD HILGART MOVED TO ADOPT THE PROPOSED AGREEMENT BETWEEN THE CITY OF MONTICELLO AND GIGABIT SQUARED TO PROVIDE PROFESSIONAL CONSULTING SERVICES FOR MANAGEMENT AND OPERATIONS OF FIBERNET MONTICELLO. TOM PERRAULT SECONDED THE MOTION. MOTION CARRIED 5 -0. 7. Added items • Crosswalk at 6th and Maple — Clint Herbst said that a resident contacted him asking if it would be possible to call attention to the pedestrian crossing at that intersection. Because there is no painted crosswalk at that site, drivers tend to ignore pedestrians. Council directed staff to look into the request. Stop Sign Study Update — Clint Herbst asked Bruce Westby to provide an update of the stop sign study. Bruce Westby explained that they have been conducting some small studies of the intersections along Maple Street. Bruce Westby also noted that TDS and Charter have moved their pedestals at 4th and Maple which has helped with visibility at that spot. Bruce Westby indicated that the speed trailer is not working out so well to utilize for the study. It can only take counts in one direction at a time so it is taking a while to accumulate data. He feels it will take a couple of months before they will have adequate data. Jeff O'Neill commented that it is taking quite a bit of staff time to constantly adjust the speed trailer and wondered if it might be worth the expense to use a different device to conduct the speed studies. Clint Herbst asked Bruce Westby to come back to Council at the next meeting with a report and any recommendations at this time. 8. Adjournment GLEN POSUSTA MOVED TO ADJOURN THE MEETING AT 7:39 P.M.
