RESOLUTION NO. 2011-56
GRANTING ISSUANCE OF A CABLE TELEVISION FRANCHISE TO
BRIDGE WATER TELEPHONE COMPANY, DBA TDS TELECOM
WHEREAS, Minnesota Statutes Chapter 238 provides that a municipality shall require a
franchise or extension permit of any cable communications system providing service within the
municipality; and,
WHEREAS, Bridge Water Telephone Company, dba TDS Telecom, wishes to provide cable
video services as part of its telecommunications services, and submitted a written request to the
City, which was received May 3, 2011; and,
WHEREAS, a resolution was adopted by the Monticello City Council on May 9, 2011
authorizing an Intent to Consider applications for a cable franchise and subsequently published
notification of an Intent for Issuance of a Cable Franchise on June 2 and 9, 2011, with
applications to be accepted on or before June 22, 2011; and,
WHEREAS, a resolution was adopted by the Monticello City Council on June 13, 2011, calling
for a public hearing; and,
WHEREAS, the City has conducted a public hearing on June 27, 2011, affording reasonable
notice and a reasonable opportunity to be heard with respect to all applications for a cable
franchise; and,
WHEREAS, the Monticello City Council has reviewed the contents of the franchising proposal,
submitted by Bridge Water Telephone Company, dba TDS Telecom, as required by Chapter 238.
NOW. THEREFORE, BE IT RESOLVED. by the City Council for the City of Monticello, that
the City Council finds:
1. That the Bridge Water Telephone Company, doing business as TDS Telecom, has
the legal, technical and financial qualifications necessary to provide cable
communications services to the citizens of the City at competitive rates.
2. That the proposed system will provide a mix, level and quality of programs and
services, including public, educational, governmental and institutional services,
that meets or exceeds those required of the incumbent provider.
3. That the proposed system has customer service and system maintenance plans to
ensure the provision of high quality services to the subscriber.
4. That the system design and proposed operation of a cable communication system
by TDS Telecom, as proposed, is in the best interests of the citizens of the City of
Monticello,
BE IT FURTHER RESOLVED, that the City of Monticello hereby states it intent to grant a
cable franchise to Bridge Water Telephone Company, dba TDS Telecom, and will consider
approval of a draft franchise ordinance and agreement with TDS Telecom at an upcoming
Council meeting; and,
BE IT FURTHER RESOLVED, that adoption of a final cable franchise ordinance and
agreement is subject to approval by the Sherburne Wright Cable Commission.
