Planning Commission Resolution 2012-001CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION NO. 2012 —001 Date: January 3'd, 2012" Resolution No. 2012 -001 Motion By: \[D i y�� Seconded By: �— J 10 A RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT FOR A DUPLEX RESIDENTIAL USE IN AN R -3 DISTRICT WHEREAS, Mary K Bondhus has requested an Conditional Use Permit for a duplex residential use at the property legally described as, which is located in an R -3 District; and WHEREAS, the Planning Commission has reviewed the application for Conditional Use Permit for Conditional Use Permit pursuant to the regulations of the Monticello Zoning Ordinance; and WHEREAS, the Planning Commission held a public hearing on January 3rd, 2012 on the application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the Planning Commission of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: i. The application is consistent with the 2008 Monticello Comprehensive Plan for Places to Live. 2. The conversion of single - family residential dwellings to duplex dwellings within the R -3 District would lessen their degree of density nonconformity. 3. Conversion of the home to a duplex dwelling will have little or no impact on site vegetation, pending areas and the adjacent river shoreline. n. The proposed use is not expected to diminish or impair property values in the vicinity of the site. 5. The use is not expected to be detrimental to the health, safety, morals or welfare of persons residing or working near the use. 6. The duplex use is not expected to impede development of surrounding properties, nor the future redevelopment of this property. NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of Monticello, Minnesota: 1. Pursuant to Minn. Stat. §462.357, the application for Conditional Use Permit for duplex residential use within an R -3 (Medium Density Residential) District is hereby recommended to the City Council for approval. 2. The recommendation for approval is subject to those Conditions as follows: a. City Officials approve the Zoning Ordinance Amendment making an allowance for the conversion of single family residential dwellings to duplex dwellings in the R -3 Zoning District by conditional use permit. b. The floor area of the duplex dwelling comply with the minimum area requirements of Chapter 5 of the Zoning Ordinance (based upon the number of bedrooms provided). C. Not less than two off - street parking spaces be provided per dwelling unit within an enclosed garage. Such garage shall measure not less than 400 square feet in size. d. During the use of the property as a two - family structure under the CUP, no subdivision shall be permitted that would alter the use of the property. This restriction is not intended to restrict conveyances of portions of the property for public use. e. All driveways and required off - street parking spaces be surfaced with concrete, bituminous or approved equivalent. f Issues related to grading and drainage shall be subject to review and comment by the City Engineer.
