RESOLUTION NO. 2012-056
APPROVING A SIMPLE SUBDIVISION AND ADMINISTRATIVE LOT
COMBINATION FOR LOTS 1, 2 AND 3, BLOCK 38, LOWER MONTICELLO
WHEREAS, the City of Monticello did receive an application dated May 10, 2012, from the
owner of Lots 1 and part of 2, Block 38, Lower Monticello Addition, requesting a simple
subdivision and administrative lot combination involving Lots 1, 2 and 3 of Block 38 in said
addition; and
WHEREAS, on June 5, 2012, the Monticello Planning Commission reviewed this request and
unanimously recommended approval by the Monticello City Council, contingent upon recording
of the revised Certificate of Survey;
NOW THEREFORE, BE IT HEREB Y RESOL VED BY THE CITY COUNCIL OF
MONTICELLO, MINNESOTA: that the following described parcels are hereby approved as a
Simple Subdivision:
PARCEL A:
That part of Lots 2 and 3, Block 38, LOWER MONTICELLO, according to the recorded
plat thereof, Wright County, Minnesota described as follows: Commencing at the
midpoint of the southwesterly line of said Lot 3; thence southeasterly along the
southwesterly line of said Lot 3 and Lot 2, a distance of 66.05 feet to the midpoint of said
southwesterly line of Lot 2; thence northeasterly on line with the midpoint of the
northeasterly line of said Lot 2, a distance of 116.00 feet to the point of beginning of the
land to be described; thence continue northeasterly along the last described course, a
distance of 48.98 feet to said midpoint of the northeasterly line of Lot 2; thence
northwesterly along the northeasterly line of said Lots 2 and 3, a distance of 66.12 feet to
midpoint of said northeasterly line of Lot 3; thence southwesterly along a line drawn
from said midpoint of the southwesterly line of Lot 3 to said midpoint of the
northeasterly line of said Lot 3, a distance of 48.99 feet to the intersection of a line drawn
northwesterly parallel with said southwesterly line of said Lots 2 and 3 from said point of
beginning; thence southeasterly along said parallel line, a distance of 66.10 feet to the
point of beginning.
PARCEL B:
That part of Lots 2 and 3, Block 38, LOWER MONTICELLO, according to the recorded
plat thereof, Wright County, Minnesota described as follows: Beginning at the midpoint
of the southwesterly line of said Lot 3; thence southeasterly along the southwesterly line
of said Lot 3 and Lot 2, a distance of 66.05 feet to the midpoint of said southwesterly line
of Lot 2; thence northeasterly on line with the midpoint of the northeasterly line of said
Lot 2, a distance of 116.00 feet; thence northwesterly parallel with said southwesterly
line of Lot 2 and Lot 3, a distance of 66.10 feet to a line drawn from said midpoint of the
southwesterly line of Lot 3 to the midpoint of the northeasterly line of said Lot 3; thence
southwesterly along said line, a distance of 116.06 feet to the point of beginning.
PARCEL C:
Lot 1, Block 38, TOWNSITE OF LOWER MONTICELLO, according to the recorded
plat thereof, Wright County, Minnesota.
Also:
All that part of Lot 2, Block 38, in the TOWNSITE OF LOWER MONTICELLO, or
Moritzious, according to the plat by R. J. Mendenhall of record, lying easterly of a line
drawn equidistant between the easterly and westerly lines of said Lot 2 and parallel to the
westerly line of said Lot.
NOW THEREFORE, BE IT FURTHER RESOLVED: that the Monticello City Council
approves the Administrative Lot Combination of Parcels B and C described as follows:
PARCEL B AND C TOGETHER:
Lots 1, 2 and 3, Block 38, LOWER MONTICELLO, according to the recorded plat
thereof, Wright County, Minnesota lying southeasterly of a line drawn northeasterly from
the midpoint of the southwesterly line of said Lot 3 to the midpoint of the northeasterly
line of said Lot 3 except that part described as follows: That part of Lots 2 and 3, Block
38, LOWER MONTICELLO, according to the recorded plat thereof, Wright County,
Minnesota described as follows: Commencing at the midpoint of the southwesterly line
of said Lot 3; thence southeasterly along the southwesterly line of said Lot 3 and Lot 2, a
distance of 66.05 feet to the midpoint of said southwesterly line of Lot 2; thence
northeasterly on line with the midpoint of the northeasterly line of said Lot 2, a distance
of 116.00 feet to the point of beginning of the land to be described; thence continue
northeasterly along the last described course, a distance of 48.98 feet to said midpoint of
the northeasterly line of Lot 2; thence northwesterly along said northeasterly line of Lots
2 and 3, a distance of 66.12 feet to midpoint of said northeasterly line of Lot 3; thence
southwesterly along a line drawn from said midpoint of the southwesterly line of Lot 3 to
said midpoint of the northeasterly line of said Lot 3, a distance of 48.99 feet to the
intersection of a line drawn northwesterly parallel with said southwesterly line of said
Lots 2 and 3 from said point of beginning; thence southeasterly along said parallel line, a
distance of 66.10 feet to the point of beginning.
NOW THEREFORE, BE IT FURTHER RESOLVED: that granting of said simple subdivision
is subject to the following contingencies:
• The City Engineer shall provide comment and recommendation regarding grading,
drainage and related easement issues.
• The Applicant shall provide a revised Certificate of Survey within 100 days of City
Council approval.
