RESOLUTION NO. 2012-089
DECERTIFYING PREVIOUS SPECIAL ASSESSMENT RELATED TO THE ELM
STREET PROJECT FOR PARCEL NUMBER 155500101411
WHEREAS, the City of Monticello previously constructed improvements to Elm Street and
assessed properties benefiting therefrom on a per lot basis, and;
WHEREAS, due to conveyance and recording errors parcel number 155 -500- 101411 was assessed
as a separate lot and;
WHEREAS, that parcel has previously been approved by the City Council to be combined to the
adjoining lot, parcel number 155 - 500 - 101417, which was properly assessed for and has paid the
assessment for the Elm Street improvement, and;
WHEREAS, the City Council is authorized to reassess the property by Minnesota Statutes 429.071
when it finds that the assessment or any part thereof is excessive or determines on advice of the
municipal attorney that the assessment or proposed assessment or any part thereof is or may be
invalid for any reason,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Monticello,
Minnesota:
Pursuant to Minn. Stat. § 429.071, the City hereby determines that the previous assessment
levied against parcel 155 -500- 101411 was adopted in error and;.
2. The assessment levied against parcel 155 -500- 101411, via Roll ff 24511 -1, in the amount of
$3,025, for the improvement of Elm Street, is hereby cancelled and the City Clerk is hereby
directed to notify the County Auditor to decertify the assessment.
