RESOLUTION NO. 2012-095
ACCEPTING IMPROVEMENTS AND AUTHORIZING FINAL PAYMENT FOR
2012 STORMWATER POND IMPROVEMENTS
CITY PROJECT NO. ZSTORM -2012
WHEREAS, pursuant to a written contract with the City of Monticello awarded to Schluender
Construction, Inc. of Monticello, Minnesota, the contractor has satisfactorily completed the work for
stormwater pond improvements to two city -owned stormwater ponds, one being located in the
northeast corner of the intersection of Chelsea Road & Marvin Road and the other located east of the
Monticello Middle School, including other appurtenant work in accordance with the contract;
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MONTICELLO, MINNESOTA that the work completed under said contract is hereby accepted
and approved and that the Mayor and City Clerk are hereby directed to issue a proper order for the
final payment on such contract subject to receipt of the following:
1) IC 134 forms showing that the contractor has complied with the provisions of Minnesota Statutes
290.92 requiring withholding state income tax;
2) Lien waivers showing that all claims against the contractor by reasons of the contract have been
fully paid or satisfactorily secured; and,
3) Consent of Surety to Final Payment certification from the contractor's surety.
