APPROVING AN ASSESSMENT AGREEMENT WITH RW LAND HOLDINGS, LLC
FOR SPIRIT HILLS DRAINAGE CORRECTION IMPROVMENTS TO BE APPLIED
TO OUTLOT B, SPIRIT HILLS ADDITION (PID 155- 152- 000020)
CITY PROJECT NO. 2006-10C
WHEREAS, a Grant of Easement, issued July 5, 2006, between the City of Monticello and RW
Land Holdings, LLC allowed an easement for drainage and utilities across Outlet B of Spirit
Hills Addition. Said easement agreement provided for reimbursement to the City for drainage
improvements on this property in the amount of $18,254.75, with the amount to be paid when the
property was platted into buildable lots or June 1, 2011, whichever occurs first; and
WHEREAS, the City desires to be reimbursed for the improvements and has sent invoices to
Roger Winkelman of RW Land Holdings, LLC starting in February, 2012; and
WHEREAS, the City is willing to enter into an assessment agreement over a period of five (5)
years at an interest rate of 4.75 %, with the intent of collecting said reimbursement on the
drainage improvements as provided in the Grant of Easement; and
WHEREAS, on November 8, 2012, a signed Assessment Agreement was received from Roger
Winkelman of RW Land Holdings, LLC; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO,
MINNESOTA: that the City Council approves the Agreement of Assessment and Waiver of
Irregularity and Appeal as signed and received from RW Land Holdings, LLC. Said assessment
will be assigned to Outlot B of Spirit Hills Addition (PID 155- 152 - 000020) for 5 years starting in
2013 payable tax year at an interest rate of 4.75% per annum.
