RESOLUTION NO. 2013-009
APPROVING PLANS AND SPECIFICATIONS,
AUTHORIZING ADVERTISEMENT FOR BIDS, AND
APPROVING EASEMENT AGREEMENT WITH XCEL ENERGY FOR THE
GREAT RIVER TRAILWAYS AND TRAILHEAD IMPROVEMENTS
CITY PROJECT NO. 100010
WHEREAS, pursuant to resolutions approved by the City Council on March 281h, July 11", and
July 251h, 2011, and on May 29th, 2012, the City Engineer has prepared plans and specifications
for the Great River Trailways and Trailhead Improvements which includes the construction of
four (4) trailway segments located on City right of way, Wright County highway right of way,
Wright County park land, and Xcel Energy's Monticello Nuclear Generating Plant (MNGP) site;
and
WHEREAS, the City Engineer has presented such plans and specifications to the Council for
approval; and
WHEREAS, the City of Monticello and Northern States Power (NSP), dba Xcel Energy, desire
to enter into an Easement and Agreement for use of property owned by NSP for a Multi Use
Recreation Trail system;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO,
MINNESOTA:
1. Such plans and specifications, a copy of which is on file in the office of the City Clerk,
are hereby approved.
2. The City Clerk shall prepare and cause to be inserted in the official paper, and in Finance
and Commerce and /or Construction Bulletin, an advertisement for bid upon the making
of such improvement under such approved plans and specifications. The advertisement
shall be published no less than three weeks before the last day for submission of bids,
once in the City's legal publication and at least once in either a newspaper published in a
city of the first class or a trade paper. To be eligible as a trade paper, a publication shall
have all the qualifications of a legal newspaper except that, instead of the requirement
that it shall contain general and local news, such trade paper shall contain building and
construction news of interest to contractors in this state, among whom it shall have a
general circulation.
The advertisement shall specify the work to be done, and shall state that bids will be
opened at 10:30 a.m, on April 4, 2013, and that the award of the bid and the
responsibility of the bidders will be considered by the City Council at 7 p.m. on April 22,
2013 in the Council Chambers of City Hall. Any bidder whose responsibility is
questioned during consideration of the bid will be given an opportunity to address the
Council on the issue of responsibility. No bids will be considered unless sealed and filed
with the Clerk and accompanied by a cash deposit, cashier's check, bid bond or certified
check payable to the City for 5% of the amount of such bid.
BE IT FURTHER RESOLVED, that the Monticello City Council hereby approves the
Easement and Agreement between Northern States Power and the City of Monticello for a Multi
Use Recreation Trail, including a Trail Head Facility and all necessary ponding and drainage
areas.
