RESOLUTION NO. 2013-028
ERING IMPROVEMENTS FOR WEST 7TH STREET EXTENSION (MINNESOTA
TO CR39) AND ELM STREET (7TH STREET TO THE SOUTH TERMINUS),
CITY PROJECT NO. 12C002
WHEREAS, a resolution was adopted by the City Council on March 25, 2013, accepting the
Feasibility Report with reference to proposed improvements to West 7th Street for extending the
road from Minnesota Street to Elm Street including the construction of streets, curb and gutter,
pathway, street lighting, ponding, public utilities as needed, and other appurtenant work; and
WHEREAS, the City Council requested consideration of two alternate bids: (1) mill and overlay
of West 7th Street between Elm Street and County Rd 39 (Golf Course Road), and (2) paving of
Elm Street lying south of 7th Street running to the south terminus at I -94; and
WHEREAS, a resolution was adopted by the City Council on March 25, 2013, and amended on
April 8, 2013, calling for a Public Hearing on April 22, 2013, where the Council will consider
the proposed improvements in accordance with the feasibility reports and the assessment of
abutting properties for all or a portion of the cost of the improvements pursuant to Minnesota
Statutes, Chapter 429; and
WHEREAS, on April 11th and April 18th, 2013, the City published notice of a Public Hearing to
be held on April 22nd, 2013, to consider ordering improvements for said project; and
WHEREAS, on April 9th, 2013, affected property owners were mailed a notice of the Public
Hearing to be held April 22nd, 2013; and
WHEREAS, at said hearing there was available a reasonable estimate of the amount to be
assessed and a description of the methodology was presented.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Monticello,
Minnesota as follows:
1. Said improvements are necessary, cost - effective, and feasible as detailed in the
Feasibility Reports.
2. It is advisable, expedient and necessary that said improvements as described in the Notice
of Hearing thereon be constructed, and the same are hereby ordered made.
The improvements described in said Notice of Hearing are hereby designated and shall be
lmown as the West 7th Street Extension (Minnesota to CR39) and Elm Street (7th Street to
the south terminus), City Project No. 12C002.
4. The City Council shall let the contract for all or part of the work for said improvements
or order all or part of the work done by day labor or otherwise as authorized by
Minnesota Statutes, Section 429.041, Subdivision 2 within one year of the date of this
resolution ordering said improvements.
