RESOLUTION NO. 2013-077
APPROVING VACATION OF DRAINAGE AND UTILITY EASEMENTS
AND APPROVING ADMINISTRATIVE LOT COMBINATION,
LOTS 2 AND 3, BLOCK 1, PINE VIEW ADDITION
PID 155- 204 - 001020 AND 155- 204 - 001030
WHEREAS, the City of Monticello did receive a petition dated August 9th, 2013, from the
owner of Lots 2 and 3, Block 1, Pine View Addition requesting vacation of a portion of the 12
foot drainage and utility easement on the boundary lying between said lots; and
WHEREAS, the City has also received a request from KK Construction, Inc. for an
Administrative Lot Combination of said Lots 2 and 3, Block 1, Pine View Addition, subject to
vacation of the easement; and
WHEREAS, on September 5 and 12, 2013, the City published notice of a Public Hearing to be
held on September 23rd, 2013, to consider vacating a portion of the drainage and utility
easement on the boundary lying between Lots 2 and 3, Block 1, Pine View Addition; and
WHEREAS, on September 9, 2013, affected property owners were mailed a notice of the Public
Hearing to be held September 23rd, 2013;
NOW THEREFORE, BE IT HEREB Y RESOL VED BY THE CITY COUNCIL OF
MONTICELLO, MINNESOTA: that the following described portion of drainage and utility
easements be vacated:
Legal description for the vacation of a portion of Lots 2 and 3, Block 1, PINE VIEW
ADDITION:
The drainage and utility easement across the Southeasterly 6.00 feet of Lot 2, Block 1
and the Northwesterly 6.00 feet of Lot 3 of said Block 1 in Pine View Addition in the
City of Monticello, according to the recorded plat thereof, Wright County, Minnesota,
lying southwesterly of the Northeasterly 12.00 feet of said Lots 2 and 3 and lying
northeasterly of the Southwesterly 12.00 feet of Lots 2 and 3.
NOW THEREFORE, BE IT FURTHER RESOLVED: that the Monticello City Council
approves the Administrative Lot Combination of Lots 2 and 3, Block 1, Pine View Addition
described as follows:
New combined legal description of Lots 2 and 3, Block 1, Pine View Addition:
All that part of Lot 2 and Lot 3, Block 1, PINE VIEW ADDITION, according to said plat
on file and of record in the office of the County Recorder, Wright County, Minnesota.
NOW THEREFORE, BE IT FURTHER RESOLVED: that granting of said vacation is subject
to the following conditions:
• Property owner shall provide a revised Certificate of Survey showing the reestablishment
of drainage and utility easements and showing the combined Lots 2 and 3, Block 1, Pine
View Addition.
• The property owner shall be required to cap water services per the recommendation of the
City Water Superintendent.
• The combined property shall be developed utilizing the existing shared access on Lots 3
and 4, Block 1, Pine View. No additional access shall be provided.
• The City shall continue to maintain the remaining drainage and utility easement on the
perimeter of the property.
• If private utilities exist within the easement area to be vacated, it will be the property
owner's responsibility to work with the private utilities to relocate their utilities.
• Property may be subject to double assessment for future road improvements, based on
original two lots.
ADOPTED BY the Monticello City Council this 23rd day of September, 2013.
