City Council Resolution 2014-30CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION NO. 2014-030 APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING ADVERTISEMENT FOR BIDS, CALLING FOR IMPROVEMENT AND ASSESSMENT HEARINGS, AND ORDERING PREPARATION OF ASSESSMENT ROLLS FOR HILLSIDE 3" AND 4TH ADDITION PUBLIC IMPROVEMENTS CITY PROJECT NO.12CO08 WHEREAS, pursuant to a resolution by the City Council on February 10, 2014, a Feasibility Report has been prepared by the City's Consulting Engineer and approved by the City Council on March 10, 2014, with reference to the proposed public improvements for the Hillside 3rd and 4th Additions described as follows: The remaining public improvements include the final lift of pavement on the development's internal streets, sidewalk construction along Deer Street and Bison Avenue, utility adjustments, cluster mailbox placement, trail construction along Fenning Avenue adjacent to the development, internal trail extension north of Deer Street on the east side of the development, installation of conservation easement posts, silt fence removal, cleanup, and other associated appurtenant work. WHEREAS, pursuant to a resolution approved by the City Council on March 10, 2014, the City's Consulting Engineer has prepared plans and specifications for the Hillside 3rd and 4th Addition Improvements; and WHEREAS, the City Engineer has presented such plans and specifications to the Council for approval; and WHEREAS, the City intends assess the benefitting properties subject to award of contract; NO W THEREFORE, BE IT RESOL VED B Y THE CITY CO UNCIL OF MONTICELL 0, MINNESOTA: 1. Such plans and specifications, a copy of which is on file in the office of the City Clerk, are hereby approved. 2. The City Clerk shall prepare and cause to be inserted in the official paper and in the Star Tribune and /or Construction Bulletin an advertisement for bid upon the making of such improvement under such approved plans and specifications. The advertisement shall be published no less than three weeks before the last day for submission of bids, once in the City's legal publication and at least once in either a newspaper published in a city of the first class or a trade paper. To be eligible as a trade paper, a publication shall have all the qualifications of a legal newspaper except that, instead of the requirement that it shall contain general and local news, such trade paper shall contain building and construction news of interest to contractors in this state, among whom it shall have a general circulation. The advertisement shall specify the work to be done, and shall state that bids will be opened at 10:30 a.m. on April 7, 2014, and that the award of the bid and the responsibility of the bidders will be considered by the City Council at 7 p.m. on April 28, 2014, in the Council Chambers of City Hall. Any bidder whose responsibility is questioned during consideration of the bid will be given an opportunity to address the Council on the issue of responsibility. No bids will be considered unless sealed and filed with the Clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check payable to the City for 5% of the amount of such bid. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA: 1. The Council will consider the proposed improvements for said streets in accordance with the Feasibility Reports and the assessment of abutting properties for all or a portion of the cost of the improvements pursuant to Minnesota Statutes, Chapter 429 at an estimated total cost of the improvements of $226,780. 2. A public hearing shall be held on such proposed improvements on the 28th day of April, 2014 in the Council Chambers of City Hall at 7 p.m. and the Clerk shall give mailed and published notice of such hearing and improvements as required by law. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF MONTICELL 0, MINNESOTA: 1. The City Council hereby determines that a portion of the cost for said improvements shall be assessed against benefitted property owners based upon benefits received without regard to cash valuation. 2. The City Administrator shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land without regard to cash valuation as provided by law, and he shall file a copy of such proposed assessment in his office for public inspection. 3. A hearing shall be held on the 28th day of April, 2014 at 7 p.m. in the Council Chambers at the Monticello Community Center to pass upon such proposed assessment and.at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 4. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing and shall state in the notice the total cost of the improvement. The Clerk shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearing. 5. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment to the City, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. Payment of the balance in whole must be made before November 15, 2014, or interest will be charged through December 31 st of the succeeding year for the first year's portion of the assessment. In subsequent years, the property owner may at any time thereafter, pay to the City the balance of the assessment remaining unpaid after the current year, provided such payment is made prior to November 15tH 6. The City Clerk shall forthwith transmit a certification of this assessment to the county auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes. ADOPTED B Y the Monticello City Council this 24th day of March, 2014.
