A VARIANCE TO REQUIRED SIDE YARD SETBACKS IN THE MISSISSIPPI WILD
AND SCENIC RECREATIONAL OVERLAY DISTRICT AND TO REQUIRED FRONT
YARD SETBACKS IN THE R -1 (SINGLE- FAMILY RESIDENCE) DISTRICT
WHEREAS, Darlene Weese is requesting a variance form side and front yard setback
requirements in the R -1, Single Family and WSRR Overlay Districts to be able to construct an
attached garage on her existing home; and
WHEREAS, the applicant has submitted a site survey illustrating the location of the proposed
garage on her property for review by City staff; and
WHEREAS, upon review of site conditions planning staff recommended approval of the
requested setback variance based on the finding that practical difficulties result from the unique
configuration of the subject parcel; and
WHEREAS, the Planning Commission held a public hearing on April 1, 2014 on the application
and the applicant and members of the public were provided the opportunity to present
information to the Planning Commission; and
WHEREAS, the Planning Commission has considered all of the comments and the staff report,
which are incorporated by reference into the resolution; and
WHEREAS, the Planning Commission of the City of Monticello makes the following Findings
of Fact in relation to the approval of the variance:
1. The applicant has demonstrated practical difficulties in improving her property in a
reasonable manner, due to the unique configuration of her shoreline lot resulting in
minimal buildable area; and
2. The applicant wishes to construct a garage on her property where no garage currently
exists. A garage is an allowed single family residential use, and the proposed structure is
comparable in size to surrounding single family garages.
3. The requested garage project is able to meet general zoning and WSRR District criteria
for variance approval with the condition that the applicant implements stormwater
management methods on the subject property for mitigation of increased stormwater
runoff resulting from garage construction.
NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of
Monticello, Minnesota, that the requested is approved based on the conditions provided in
Exhibit Z of the referenced staff planning report.
ADOPTED this 1�` day of April 2014, by the Planning Commission of the City of
Monticello, Minnesota.
