Planning Commission Resolution 2014-060CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA PLANNING COMMISSION RESOLUTION NO. 2014 -060 Motion By: Burvee Seconded By: Gabler RECOMMENDING APPROVAL OF AN AMENDMENT TO CONDITIONAL USE PERMIT FOR PLANNED UNIT DEVELOPMENT FOR AMAX STORAGE AT 36 DUNDAS ROAD WHEREAS, the applicant, owner of the property at the above -named address has requested an amendment to an existing PUD; and WHEREAS, said amendment will accommodate a land use that is consistent with the existing allows uses on the property; and WHEREAS, the proposed use, together with the recommended conditions of approval, will constitute a use that is consistent with the intent of the zoning ordinance and comprehensive plan; and WHEREAS, the Planning Commission held a public hearing on June 3'd, 2014 on the application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the Planning Commission of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: 1. The proposed use is consistent with the intent of the zoning ordinance of the City of Monticello; 2. The proposed uses in the PUD, in combination with the future intended changes to the property, justify the interim approvals under the PUD as proposed; 3. The PUD will not be detrimental to the reasonable use and development of surrounding property; 4. The PUD will not create negative impacts on surrounding public roadways or other public facilities. CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA PLANNING COMMISSION RESOLUTION NO. 2014 -060 NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of Monticello, Minnesota, that the amendment to PUD for Amax Storage is recommended for approval, subject to the following conditions: 1. The amendment shall be treated as an interim use under the existing planned unit development for a period not to exceed five years (5) years, after which the site will require a new amendment, and be returned to a condition in compliance with all applicable zoning regulations in effect at that time. 2. The applicant shall mark and submit drainage and stormwater plans identifying catch basin elevations and drainage patterns, in accordance with the requirements of the City Engineer. 3. If the area designated for temporary storage units is vacant for a period of at least twelve months, the amendment shall expire, and the property be returned to a surface in accordance with zoning regulations. 4. No active business or other occupancy may be made of the temporary storage buildings, with the exception of storage, and loading or unloading of said storage. 5. The applicant shall verify the type and material of the current surfacing for the outdoor storage area. The material_ shall_ be sufficient to control dust. 6. The applicant shall enter into an encroachment agreement as related to the retaining wall and placement of outdoor storage within the existing southern drainage and utility easement. The proposed storage units shall remain 6' from the property line. 7. The applicant shall enter into a development agreement with the City specifying the terms of the PUD, including the termination date as agreed to by the City Council.
