RESOLUTION NO. 2014 -078

RECOMMENDING THAT THE CITY COUNCIL ADOPT ORDINANCE NO. 601
AMENDING THE ZONING ORDINANCE RELATED TO APPELLANTS OF
BOARD OF APPEALS AND ADJUSTMENTS DECISIONS
WHEREAS, the Monticello Zoning Ordinance currently permits appeals of the decisions of
the Board of Appeals and Adjustments to applicants only; and
WHEREAS, parties other than the applicant may be affected by such decisions; and
WHEREAS, State law governing such appeals states that any affected party must be allowed
to appeal such decision; and
WHEREAS, the current CUP timing language requires clarification to be internally
consistent for action under a CUP approval; and
WHEREAS, the Planning Commission held a public hearing on August 5a', 2014 on the
application and members of the public were provided the opportunity to present information
to the Planning Commission; and
WHEREAS, the Planning Commission has considered all of the comments and the staff
report, which are incorporated by reference into the resolution; and
WHEREAS, the Planning Commission of the City of Monticello makes the following
Findings of Fact in relation to the recommendation of approval:
1. The current zoning ordinance language is inconsistent with State law.
2. The amendment will correct the inconsistency.
3. The amendment will accommodate the ability of the City Council, as the elected
governing body, to ensure that official city policy is furthered.
4. The amendment will correct internal timing inconsistencies related to Conditional
Use Permit approvals.
NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of
Monticello, Minnesota, that the Planning Commission recommends adoption of Ordinance
No. 601 by the City Council.
