City Council Resolution 2014-82CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION NO. 2014-082 APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT FOR LIBERTY PARK SECOND ADDITION WHEREAS, VHM Holdings, LLC has submitted an application for final plat approval for the proposed development of Liberty Park Second Addition; and WHEREAS, the preliminary and final plat will meet design standards and other provisions outlined in Title XI, the Monticello Subdivision Ordinance subject to conditions enumerated below; and WHEREAS, the proposed final plat is consistent with the approvals and expectations of the original preliminary plat for the property; and WHEREAS, Retail Commercial Uses are permitted in the B -2 Highway Business District, the underlying zoning of the parcel; and WHEREAS, the applicant has provided plans for development of the property that, with staff conditions as noted, will permit the development of the property consistent with the zoning ordinance; and WHEREAS, the City Council of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: 1. The plat of Liberty Park Second Addition meets all requirements of the City's applicable ordinances. 2. The plat of Liberty Park Second Addition is consistent with the approvals granted as a part of the Liberty Square preliminary plat. NO W THEREFORE, BE IT RESOL VED B Y THE CITY CO UNCIL OF MONTICELL 0, MINNESOTA, the final plat of the Liberty Park Second Addition is hereby approved, contingent upon meeting all conditions of the subdivision ordinance; and the following conditions: 1. Easements shall be platted per City Engineer recommendations. 2. The plans shall comply with the recommendations of the City Engineer regarding stormwater, utilities, and other issues. 3. Development of the site shall be consistent with the requirements of the applicable zoning district (B -2) and overlays (Mississippi Wild Scenic and Recreational River). 4. The applicant shall provide for contemporaneous execution of a permanent easement for trail and sidewalk purposes along CSAH 39. 5. The plat is subject to the comments of the Wright County Highway Engineer. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF MONTICELL0, MINNESOTA, that the Development Agreement for Liberty Park Second Addition, with assignment of the specific terms and conditions for public improvements and the specific terms and conditions for plat development, is hereby approved.
