RESOLUTION NO. 2014 -107

RECOMMENDING THAT THE CITY COUNCIL ADOPT ORDINANCE NO. 603
AMENDING THE ZONING ORDINANCE, TABLE 5 -1A, DESIGNATING
PERSONAL SERVICES AS A PERMITTED USE IN THE CCD L -2 SUB - DISTRICT
WHEREAS, the Monticello Zoning Ordinance currently allows Personal Services in the
CCD L -2 district by CUP, and only on upper floors; and
WHEREAS, the intent of the L -2 District is for River- oriented shopping, including tourism,
entertainment, and recreational uses; and
WHEREAS, Personal Services, as defined in the Zoning Ordinance, includes many uses that
fit the intent of the L -2 District; and
WHEREAS, the Planning Commission held a public hearing on October 27th, 2014 on the
application and members of the public were provided the opportunity to present information
to the Planning Commission; and
WHEREAS, the Planning Commission has considered all of the comments and the staff
report, which are incorporated by reference into the resolution; and
WHEREAS, the Planning Commission of the City of Monticello makes the following
Findings of Fact in relation to the recommendation of approval:
1. The current zoning ordinance language unnecessarily limits the use of properties
in the L -2 sub - district.
2. The amendment provides the opportunity for a variety of businesses that meet the
intent of the downtown objectives in the Comprehensive Plan.
3. The amendment will facilitate the use and revitalization of the downtown area by
permitting such uses.
NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of
Monticello, Minnesota, that the Planning Commission recommends adoption of Ordinance
No. 603 by the City Council.
