AN ORDINANCE AMENDING THE MONTICELLO CITY CODE RELATING TO
HOURS WHEN CUSTOMERS ARE ALLOWED ON PREMISES AT ON -SALE
LIQUOR ESTABLISHMENTS, WITHIN THE FOLLOWING SECTIONS: 3 -1 BEER, 3-
2 LIQUOR, 3 -4 LIQUOR BY THE DRINK, 3 -11 ON -SALE WINE LICENSE
IT IS HEREBY ORDAINED BY the City Council of the City of Monticello, Minnesota:
Section 1. Title 3, Chapter 1 - Beer, shall be amended as follows:
3 -1 -6: PERSONS INELIGIBLE FOR LICENSE: No license shall be granted to
any person:
(A) Under eighteen (_7 °'(_') twenty -one (21) years of age, or as stipulated
in Minnesota state statutes.
3 -1 -8: CONDITIONS OF LICENSE: Every license is subject to the conditions
in the following subsection and all other provisions of this ordinance
and of other applicable ordinance, state law, or regulation.
(C) No beer shall be sold or served to any intoxicated person or to any
person under eighteen 8) twenty -one (21) years of age, or as
stipulated in Minnesota state statutes.
(D) No minor under eighteen (18) shall be eniployed on th .

establishment.
(K) Every licensee shall be prohibited from conducting business on the
premises from 2:00 a.m. to 8:00 6:00 a.m., Monday through

Section 2. Title 3, Chapter 2 - Liquor, shall be amended as follows:
3 -2 -8: CONDITIONS OF LICENSE:

Section 3. Title 3, Chapter 4 — Liquor by the Drink, shall be amended as follows:
Add new sections to index (and renumber existing sections accordingly):

3 -4 -5: Days and Hours of Sale
3 -4 -6. Special Provisions: Sports, Conventions or Cultural Facilities,
Community Festivals
Remove 3 -4 -3(F ) and replace with the following section:
3 -4 -4. CONDITIONS OFLICENSE. Every licensee shall be prohibited from
conducting business on the premises from 2:00 a.m, to 840 6:00 a.m.,

Add new Section 3 -4 -5 as follows:
3 -4 -5: DAYSAND HOURS OFSALE:
(A) The hours of operation and days of sale shall be those set by
Minnesota Statutes Chapter 340A.504, as it may be amended
from time to time, except that the City Council may, by resolution
or ordinance, provide for more restrictive hours.
(B) No sale of intoxicating liquor by the drink for consumption on
the licensed premises may be made between 2:00 a.m. and 8:00
a.m. on Monday through Saturday inclusive. No sale of
intoxicating liquor by the drink for consumption on the licensed
premises may be made between 2:00 a.m. and 10:00 a.m. on
Sundays. Sales after 2:00 a.m. on Sunday are unlawful unless
the liquor license holder has obtained a Sunday liquor license in
accordance with state law.
(C) CONSUMPTIONAND DISPLAYPERMITS: No establishment
licensed under MN State Statute 340A.414 or City Code 3- 4 -3(D)
may permit a person to consume or display intoxicating liquor,

and no person may consume or display intoxicating liquor
between 1:00 a.m. and 8:00 a.m. on Monday through Saturday
inclusive, and between 1:00 am. and 12:00 noon on Sundays.
Section 4. Title 3, Chapter 1 — On -Sale Wine License, shall be amended as follows:

Amend Section 3 -11 -10 as follows:
3- 11 -10: DAYSAND HOURS OF SALE:
(A) No sale of wine under this license shall be made on the premises
between the hours of 2:00 a.m. and 8:00 a.m., Monday through
Saturday inclusive, or on any Sunday between the hours of 2:00
a.m. and 13:00 neon 10:00 a.m.

premises between the hours of 2:30 a.m. and 8:00 6:00 a.m.,

Section 5. This Ordinance shall take effect and be in full force from and after its passage
and publication. The ordinance in its entirety shall be posted on the City website
after publication. Copies of the complete City Code are available online and at
Monticello City Hall for examination upon request.
