City Council Ordinance 584ORDINANCE NO. 584 CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA AN ORDINANCE AMENDING THE MONTICELLO CITY CODE RELATING TO ALCOHOL COMPLIANCE CHECKS AND VIOLATIONS WITHIN THE FOLLOWING SECTIONS° 3 -1 -8 — BEER 3 -2 -8 — LIQUOR 3 -11 -9 - ON -SALE WINE LICENSE IT IS HEREBY ORDAINED BY the City Council of the City of Monticello, Minnesota: Section 1. Title 3, Chapter 1 - Beer, shall be amended as follows: 3 -1 -8: CONDITIONS OF LICENSE: Every license is subject to the conditions in the following subsection and all other provisions of this ordinance and of other applicable ordinance, state law, or regulation. (L) All license holders may be subject to alcohol compliance checks conducted under a resolution adopted by City Council in 2005. This agreement sets civil penalties for failing a compliance check and providing alcohol to minors. Liquor Administrative Fines are assessed as follows: (1) 1St Violation — amount as stated in the current Fee Schedule (2) 2nd Violation within 2 years — amount as stated in the current Fee Schedule (3) 3rd Violation within 2 years — amount as stated in the current Fee Schedule (with no mandatory revocation of license). Section 2. Title 3, Chapter 2 - Liquor, shall be amended as follows: 3 -2 -8: CONDITIONS OF LICENSE: Every license shall be granted subject to the conditions in the following subsection and all other provisions of this chapter and of other applicable provisions of this code or state law. (G) All license holders may be subject to alcohol compliance checks conducted under a resolution adopted by City Council in 2005. This agreement sets civil penalties for failing a compliance check and providing alcohol to minors. Title 3, Chapter 11 — On -Sale Wine License, shall be amended as follows: 3 -11 -9: CONDITIONS OF LICENSE: (F) All license holders may be subject to alcohol compliance checks conducted under a resolution adopted by City Council in 2005. This agreement sets civil penalties for failing a compliance check and providing alcohol to minors. Liquor Administrative Fines are assessed as follows: (1) Is' Violation — amount as stated in the current Fee Schedule (2) 2nd Violation within 2 years — amount as stated in the current Fee Schedule (3) 3" Violation within 2 years — amount as stated in the current Fee Schedule (with no mandatory revocation of license). Section 4. The City Clerk is hereby directed to make the changes required by this Ordinance as part of the Official Monticello City Code, and to renumber the tables and chapters accordingly as necessary to provide the intended effect of this Ordinance. The City Clerk is further directed to make necessary corrections to any internal citations that result from said renumbering process, provided that such changes retain the purpose and intent of the City Code as has been adopted. Section 5. This Ordinance shall take effect and be in full force from and after its passage and publication. The ordinance in its entirety shall be posted on the City website after publication.
