Amends and Restates Resolution No. 2007 -39
A. RESOLU'T'ION AMENDING AND R1ESTAT'ING RESOLUTION NO. 2007-39
ADOP'T'ED ON MAY 29, 2007 VACATING A PORTION OF DAYTON STREET
WHEREAS, pursuant to Minnesota Statutes § 412.851, the City Council conducted a public hearing
preceded by two weeks published and posted notice to consider the vacation of a portion of Dayton
Street. The City Council deters fined it was in the public interest to vacate a portion of Dayton Street
and Resolution No. 2007 -39 was adopted on May 29,2007;
WHEREAS, Resolution No. 2007 -39 was recorded with the Wright County Recorder on Jun 18, 2007
as Document No. 1056974 with an erroneous legal description and drawing for the vacation attached
as an exhibit;
NOW THEREFORE, BE IT HEREBY RESOL VED BY THE CITY COUNCIL OF THE CITY OF
MONTICELLO, MINNESOTA, that Resolution No. 2007 -39 recorded on June 18, 2007 as document
No. A 1056974 is hereby amended and restated to correct the drawing attached as the exhibit and that
Dayton Street legally described as follows is hereby vacated:
That part of Dayton Street as dedicated in the plat of Lower Monticello, Wright County, Minnesota
described as follows: Beginning at the most southerly comer of Block 16, Lower Monticello; thence on
an assumed bearing of North 31 degrees 58 minutes 30 seconds East along the southeasterly line of
said Block 16, a distance of 332.80 feet to the most easterly comer of said Block 16; thence South 56
degrees 39 minutes 42 seconds East, 80.02 feet to the most northerly corner of Block 25 Lower
Monticello; thence South 31 degrees 58 minutes 30 seconds West along the northwesterly line of said
Block 25, a distance of 332.87 feet to the most westerly comer of said Block 25; thence North 56
degrees 36 minutes 37 seconds West to the point of beginning and there terminating. Containing
26,527 square feet or 0.61 acres more or less.
Adopted by the Monticello City Council this 23`d day of July, 2007.
