City Council Resolution 2007-105CITY OF MONTICELLO RESOLUTION NO. 2007 -105 RESOLUTION CALLING FOR A PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ENABLING RESOLUTION ESTABLISHING THE CITY OF MONTICELLO ECONOMIC DEVELOPMENT AUTHORITY WHEREAS, the City of Monticello (the `City) has previously established an Economic Development Authority C EDN) and adapted an Amended and Restated Resolution Enabling the Creation of the City of Monticello Economic Development Authority, dated October 22, 2007 (the "Enabling Resolution!) after a duly noticed public hearing; and WHEREAS, the City Council has determined that it is necessary to amend the Enabling Resolution to clarify the membership and term provisions for EDA commissioners. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Monticello, mat: 1. The City Administrator is hereby authorized and directed to cause to be prepared an Amended and Restated Enabling Resolution for consideration by the City Council. 2. The Administrator is authorized and directed to prepare a notice for publication, in substantially the form attached as Exhibit A, in the City's official newspaper setting a public hearing before the City Council on Monday, January 14, 2008 at approximately 7:00 p.m. in the council chambers an the proposed amendment. The notice shall be published in the newspaper for two consecutive weeks, not more than 30 days prior to the public hearing. 3. The Administrator is authorized and directed to take all other actions necessary to bring the proposed amendment before the City Council at the time of the public hearing. C. - �.r 310612v1 MNIi EU360 -13 Exhibit A NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN, that the City Council of the City of Monticello will meet on Monday, January 14, 2008 at approximately 7:00 p.m. in the Council Chambers at City Hall, 505 Walnut Street, Monticello, Minnesota, to conduct a public hearing on the question of an amendment to its enabling resolution establishing an Economic Development Authority (FDA) for the City pursuant to Minnesota Statutes, Chapter 469. Summ ary of Amendment to Enabling Resolution The amendment to the enabling resolution clarifies Sections 2.03 and 2.04, the membership and terms of the EDA commissioners. Two of the members shall be members of the City Council. The term of office of the two members of the City Council shall coincide with their tam of office as members of the City Council. The remaining five members shall be initially appointed for terns of one, two, three, four, and five years respectively. Thereafter, all non - Council commissioners shall be appointed for six -year terms. A vacancy is created in the membership of the EDA when a City Council member of the board of commissioners ends Council membership. A vacancy for this or any other reason must be filled for a new term (in the case of a Council member) or the balance of the unexpired term (in the case of a non - Council member), in the manner in which the original appointment was made. Hq� At the public hearing any person wishing to express a view regarding the proposed amendment to the enabling resolution will be heard orally or in writing. At the conclusion of the hearing or any adjournment thereof the City Council will take whatever action it deems necessary with regard to the enabling resolution. A copy of the full text of the enabling resolution as proposed to be amended is on file for public inspection in the office of the City Administrator at City Hall during normal business hours.
