Planning Commission Resolution 2015-011CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA PLANNING COMMISSION RESOLUTION NO. PC- 2015 -011 RECOMMENDING DENIAL OF A MAP AMENDMENT FOR REZONING FROM B -3, HIGHWAY BUSINESS TO B -2, LIMITED BUSINESS FOR THE FOLLOWING PARCEL: 3939 CHELSEA ROAD WEST WHEREAS, the applicant seeks a rezoning for the subject property from B -3 to B -2 to accommodate a proposed occupancy of the property for a church use which is allowed as a Place of Public Assembly in the B -2 Zoning District; and WHEREAS, the area is guided for "Places to Shop" in the Monticello Comprehensive Plan; and WHEREAS, the surrounding properties to the east, west, and south are zoned B -3, Highway Business; and WHEREAS, the properties to the east and west are occupied by automotive- related business uses, and the property to the south is vacant; and WHEREAS, the B -3, Highway Business zoning district is a specialized zoning district intended to provide land for business uses that serve the traveling public; and WHEREAS, the B -2, Limited Business zoning district is intended to serve land uses that are of a more limited, community -wide scope; and WHEREAS, the Planning Commission held a public hearing on August 4t', 2015 on the application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the Planning Commission of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: 1. The property is guided for "Places to Shop" in the Comprehensive Plan. 2. The surrounding zoning provides for B -3 uses. 3. The proposed rezoning to B -2 would create a spot zone of potentially incompatible land use in the midst of a B -3 area. 4. The proposed use of the property would interrupt the pattern of automotive - related business uses that are both planned and in place in the area. 5. The B -3 District uses represent the highest and best uses of land for the subject property. CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA PLANNING COMMISSION RESOLUTION NO. PC- 2015 -011 NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of Monticello, Minnesota: That the City Council should deny the rezoning of the subject property at 3939 Chelsea Road West from B -3, Highway Business to B -2, Limited Business.
