WHEREAS, pursuant to a written contract signed with the City of Monticello o of the
Earbarossa and Sons of Osseo, Minnesota has satisfactorily completed the improvement
Southeast interceptor Trunk Sanitary Sewer Extension in accordance with such contract;

Satisfactory showing that the contractor has complied with the provisions of Minnesota Statutes
290.92 requiring withholding of state income tax.
Evidence in the form of an affidavit that all claims against the contractor by reasons of the
contract have been full paid or satisfactorily secured.

Consent of Surety to Final Payment certification f -om the contractor's surety.
Two year maintenance bond.
BE If FURTHER RESOLVED: That the City Clerk and Mayor are hereby directed to issue a proper
order for the final payment on such contract.
Adopted by the Monticello City Council this 9'h day of October, 2006.
