RESOLUTION NO. 2005-10
ACCEPTING IMPROVEMENTS
TIMBER RIDGE STORM SEWER PROJECT NO. 2002-3C
WHEREAS, under Improvement Project No. 2002-3C the City improved the storm sewer system by
construction of 460 feet of trunk storm sewer from the existing pond in the Timber Ridge development
to the Burlington Northern Railroad right-of-way and other necessary appurtenant work,
WHEREAS, the City Engineer has inspected the work constructed completed under this project and
finds it to be in conformance with the approved plans and specifications for the same,
NOW THEREFORE, BE IT HEREBY RESOL VED BY THE CITY COUNCIL OF THE CITY OF
MONTICELLO, that the improvements constructed under Improvement Project No. 2002-3C are
hereby accepted by the City of Monticello contingent upon the contractor submitting the following:
* Satisfactory showing that the contractor has complied with the provisions of Minnesota
Statutes 290.92 requiring withholding state income tax.
* Evidence in the form of an affidavit that all claims against the contractor by reasons of the
contract have been fully paid or satisfactorily secured.
* Consent of Surety to Final Payment certification from the contractor's surety.
* Two year maintenance bond.
Adopted by the Monticello City Council this 24th day of January, 2005.
